This petition is to gather resident signatures to acknowledge the situation regarding water and mud building up in the backyards and side yards of the homes built in the Willowbrook Community by Pulte Homes. Many people in our community have noticed standing water and mud in our yards and this is causing a range of other problems, including mosquitoes, slippery conditions when moving, gardening, or moving trash cans, growing moss, lack of grass growing, eroding soil, and possible long term effects on the foundation on our homes.

Correcting this measure would require a pipe to be installed underground in our yards between our houses. The pipe would be buried under the soil, would collect water more effectively and properly drain the water efficiently away from our yards and our homes. The estimate for this cost would be approximately $2000 to $3000 per home.

We are asking for the builder, Pulte Homes, to properly and responsibly address this matter. Surrounding communities do not have this problem. This is unique to the construction of these homes by Pulte. We would like either for the home builder to install the piping for us to better drain the water away, or reimburse us for the costs to fix the problem ourselves.

We want to state the serious health risk issue and that it also affects the home owners and their property value. Moss, mosquitos, and slippery conditions are only a few of the possible health concerns that many neighbors in the Willowbrook community have stated. There are also a wide range of concerns regarding the long term implications of water not draining out efficiently in the area between the homes. Many neighbors feel that this needs to be brought to light.

The builder refuses to fix the problem, or they give us the run-around, or they send people who do not fix the problem. Pulte’s representatives also tell us that there is a 48 hour rule for the water logged yards to dry. The Pulte representatives have said as long as the water dries in 48 hours it is not a problem. To some home owners they say it is 72 hour rule. When it is too water logged for grass to grow, Pulte’s representatives sometimes say residents and the HOA should work together to water the lawn after 72 hours. They even admit that without enough sun, the water between the houses will not evaporate, and there is nothing they can do to fix it.

There are far too many inconsistencies in each representatives’ explanations regarding the cause of this problem and how to fix it. The bottom line is that the vast majority of residents are unhappy and Pulte as the home builder refuses to fix it to our satisfaction. We are stating with this petition that we are unhappy with the situation and response that Pulte has given us, and we would like there to be a more responsible plan of action done by the builder.
