Sony Please Supply Us with the TV we paid for

On Friday the 4th of April 2014 a number of people entered into a binding contract with Sony Europe Limited. This contract for a “Refurbished:139cm /55”, Full HD 3D TV, Model # KDL55W905ABU.A” was advertised on the website outlet.sony.co.uk. The offer was to purchase this product for the sum of £660.00 inclusive of VAT and Delivery. The Item was showing as in stock and allowed purchasers to complete the online checkout procedure.

Shortly after completing the online purchase, customers received an email acknowledging receipt of the order and giving an estimated delivery between the dates of 10/04/2014 and 11/04/2014.

Also shortly after completing the online purchase Sony Europe Limited under the merchant description of “SONY-CENTRES.CO.UK” agreed to contractually for fill the order by receiving the sum of £660.00 from purchasers.

On Monday the 8th of April 2014 some purchasers have received an email stating the following –

“DearSonyStore Online Customer,

Please kindly be made aware that your recent Outlet store order for the refurbishedSonyTV KDL55W905ABU.A cannot be accepted.

Due to a system update a mistake occurred online onwww.sony.co.ukon Friday 4th April, whereby one refurbished KDL-55W905ABU.A BRAVIA television was listed at an incorrect price of £660 Inc VAT on theSonyOutlet store. Also due to a stock error, it was not made clear that this offer was for one TV only, asSonyhas no other stock of this refurbished model available. We apologise for this mistake. Any payment you may have made for this will be refunded in full.

We sincerely apologise for any inconvenience caused and as a valued customer and a gesture of goodwill, we would like to offer you a BRAND NEW KDL-55W905ABU, which is the same model as previously ordered, usually worth £1399 onsony.co.uk, at the discounted price of £950, thus saving you £449. Please be informed that this offer is valid for up to the same quantity as stated in your original order acknowledgement email.

This is a clear breach of contract made between the supplier and customer.

Sony we expect you to complete our mutual contracts to supply us with the product we ordered in good faith. You accepted our offer to buy by accepting our hard earned money.
