SAVE OUR HOUSING - Remove Section 16-32c footnote 9 from Nederland Municipal Town Code
Current Town Code Section 16(76) (a)(9)(k) outlines what is and is not allowed as a home occupation businesses - (k) of that code says home occupation business CAN NOT be a "use which requires a special review or a conditional use permit in the zone district" But Section 16-32 c footnote 9 says "a marijuana cultivation facility is permitted as a home occupation business in residential zoning areas under the Special Review Use (SRU) permit process". These two codes are indirect conflict of each other and we are requesting the later code (Section 6-32 c footnote 9) be removed from Town Code. We do not want a marijuana cultivation facility to have the ability to operate in a residential setting. Our town already struggles to provide affordable housing to its residents Please sign this petition to get this town code removed - lets save our residential zoning for families.

The momentum generated by this petition has prompted the town attorney to formally review the conflict between these two code sections. I am currently prepping the legal brief that details how footnote 9 contradicts our existing residential zoning protections. We will present these findings at the next planning commission meeting to ensure the record reflects our position.

I have already sent comments prior to the hearing. Young families such as ours how have limited resources to afford downpayments on homes here are at risk of being locked out. Nederland should be a community of families who live here and support the community. Families who also pay taxes. If homes are allowed to be purchased for commercial reasons, growers will take a bite out of business for the local business owners here. Growers will not live at these homes and if anyone does, transient recents are not ideal. Do not lock out families for tax dollars. We pay our share and spend money at local businesses. GROWERS HAVE NO VESTED INTEREST IN SEEING OUR COMMUNITIES AND BUSINESSES GROW.
I believe this footnote is a bad idea for many reasons, but especially two main reasons: (1) we have a big housing problem in Nederland and this will remove residences from the available pool, and (2) I believe commercial grow operations are always incompatible with residential areas and there shouldn't be the option to allow them by SRU. Commercial grow operations belong in commercial zones. Please remove section 16-32 footnote 9 from Nederland Municipal Code!
Neighborhoods with families build incredible communities. Prevent grow houses from wrecking our community! Please take this code out. Thanks
Please take this code out, we need houses for people, not businesses.
We already have too many illegal grow operations in our neighborhoods. This only provides a avenue for them to proliferate.
Please do not let our children grow up in neighborhoods where drugs infiltrate the air and community culture!
If citizens want to grow for the purpose of selling commercially they should be held to the same standards the the current commercial growers are.
