Current Town Code Section 16(76) (a)(9)(k) outlines what is and is not allowed as a home occupation businesses - (k) of that code says home occupation business CAN NOT be a "use which requires a special review or a conditional use permit in the zone district" But Section 16-32 c footnote 9 says "a marijuana cultivation facility is permitted as a home occupation business in residential zoning areas under the Special Review Use (SRU) permit process". These two codes are indirect conflict of each other and we are requesting the later code (Section 6-32 c footnote 9) be removed from Town Code. We do not want a marijuana cultivation facility to have the ability to operate in a residential setting.
