Dr Spahi was convicted in Aug 05 with indecent assault for kissing 2 adult girls outside work. He maintained that he might have kissed any of the girls on the cheek as he normally does this as part of his culture. He appealed many times (over 30 viable grounds of appeal were provided to the Courts; all these grounds were rejected without giving any explanation). Here are some of the viable grounds of his appeal:

1.The Prosecution provided copied CD evidence with Dr Spahi saying: "I am sorry I only kissed you on the Cheek now". The Expert Dr Peter Wright found that the CD may have been tampered with and stated that the voice on the CD is not Dr Spahi’s voice continuously. This Expert was expelled  out of Court 2. Police Officer said That Dr Spahi admitted trying to kiss the first Complainant. The IPCC (Ref: 2005/002004) found there is nothing to suggest this and that the Officer was at fault in recording Dr Spahi as offender without any investigation or even a statement 3. Police have tampered with the transcript of Dr Spahi’s Interviews 4. The two Complainants deleted all the text messages they exchanged with Dr Spahi so no one can validate what has actually happened 5- The Police have intimidated and threatened Dr Spahi’s alibi witnesses 6. No original physical evidence 7. contradicted complainants statements and polyfilla prosecution full of gaps. 8. Even the copied CD recording, despite being tampered with, proves that nothing happend more than a kiss on the cheek with no force applied what so ever.

Dr Spahi was subjected to death threats believed to be linked to the people involved in his case. Also to a targeted deportation case. Solicitors believe that "Justice has not been acheived and it can not even be seen that it has been acheived" in Dr Spahi's case.

We believe that Dr Spahi conviction was wrong and based on biased process and insufficent evidence. We would like the British authorities to assist Dr Spahi in getting a Pardon over this trivial, fabricated and racially motivated case against him. Set an inquiry to find out why most of the people who dealt in his case were of Jewish background (Dr Spahi is Syrian National with some Turkish backgrounds), why so many laws and Courts procedures were broken in order to convict him over a trivial case and why all his viable grounds of appeal were rejected without giving any explanation.  We would like to ask the authorities to quash his conviction or review his case in a fair trial against neutral backgrounds. We also  like to ask the British authorities to stop the targeted, fabricated and malicious deportation proceedings against Dr Spahi (over a fabricated and silly wrong tick on the box despite the following facts: there is no Dr Spahi’s signature on that particular page, the application is loose and the pages of the form are not attached to each others). We request all or any of the above in order for Dr Spahi to be able to put the case behind him and look after his two little children (both born in the UK to a British mother)
