The State of Florida manages Home Owner Associations (HOAs) through a set of laws called Chapter 720. These laws do little to protect homeowners from management and board members that do not abide by demands set forth in Chapter 720. Further, when laws are broken, the enforcement powers of the State of Florida have little to no punitive measures built into them. Consider the illustration of a police officer pulling a driver over for speeding, then issuing a ticket with no expense to the driver. The abuse would simply continue, this is the case with how Homeowner Associations are presently managed.

As a consequence of having few laws that demand transparency from an association, and coupling it with the lack of enforcement powers of these laws, we have left a majority of home owners in Florida with no safety net against abusive associations. This must change!

Estas leyes no ofrecen su!ciente protección a los propietarios contra las compañías de administración y miembros de juntas direc%vas que no se rigen por las demandas establecidas en el Capítulo 720. Además, cuando se violan estas leyes, los poderes del Estado de Florida no tienen medidas lo suficientemente severas para hacerlas cumplir. Es como si un policía de carreteras para a un conductor por exceso de velocidad, entonces le aplica una multa de $0.

Como consecuencia de tener pocas leyes que demanden transparencia de parte de las asociaciones de propietarios, y si añadimos el factor de la falta de autoridad para hacerlas cumplir, la mayoría de los propietarios de Florida no contamos con una salvaguarda contra los abusos de las asociaciones de propietarios. ¡Es necesario que esto cambie!
