Dear Neighbors,
We, the undersigned owners of Marigot Beach, care deeply about our community and believe it is time for us to come together to resolve the challenges we currently face. While we all share a love for our neighborhood, recent divisions and tensions have made it harder for us to move forward in a way that benefits everyone.
Our hope is to bring back a sense of unity and cooperation so that Marigot Beach remains the peaceful, vibrant, and supportive place we all cherish. The current 2-2 deadlock within our Board has prevented important decisions from being made, and we believe it’s time to take steps to ensure that our community can move forward positively and constructively.
To achieve this, we respectfully request a Special Meeting of the Council of Unit Owners, to be held no later than October 18, 2024, to address the following actions that we believe will restore transparency, fairness, and functionality to our governing board:
- Advisory Owner’s Vote for Board Candidates
To help resolve the current stalemate, we propose an advisory vote among owners to recommend three new board members for appointment. This will give the community a voice in shaping the future of our leadership. - Board Vote to Appoint New Directors
We ask that the current Board hold a public vote, in front of the owners, to appoint three new directors based on the advisory vote results. - Vote to Remove Directors Who Disregard Advisory Vote
If any director chooses not to vote for the top three candidates recommended by owners, we propose an immediate owners' vote to remove that director. Directors who vote in alignment with the community's preferences will not be considered for removal. - Board Vote to Appoint New Directors if Necessary
Should any directors be removed as part of the previous item, we request the Board hold another public vote to appoint new directors, ensuring a full 7-member board. - Vote to Re-Evaluate Current Officers
We propose allowing the newly appointed board to re-evaluate the current officers and decide if any changes are necessary. - Vote to Appoint New Officers
In the event of any officer positions becoming vacant, we call for a vote to appoint new officers, including President, Vice President, Treasurer, and Secretary. - Advisory Owner’s Vote on Revenue Generation
We suggest an advisory vote among owners on any new revenue generation measures before the board, allowing everyone to have a say on important financial decisions. - Advisory Owner’s Vote on Bulk Basic Cable Service
We propose an advisory vote of owners regarding whether to procure bulk basic cable service for our building. - Board Vote on Bulk Cable Service
Following the owner’s advisory vote, we request a formal board vote to decide whether to approve or disapprove the procurement of bulk basic cable services. - Vote to Adjourn the September 28th Special Meeting
Finally, we ask for a vote to permanently adjourn the Special Meeting of the Council of Unit Owners that began on September 28, 2024, and is set to resume on October 19, 2024.
We understand that some of these actions may require review by legal counsel to ensure compliance with our bylaws, and we are fully supportive of proceeding only with those that are permissible.
