PETITION FOR BOARD REMOVAL
We, the Homeowners of Vistas at Klein Lake, Call for the Immediate Removal of All Five Current HOA Board Members

PREAMBLE
We, the undersigned homeowners and residents of Vistas at Klein Lake, hereby submit this formal petition pursuant to the HOA Bylaws, which authorize the removal of Board members upon the written request of at least ten percent (10%) of all member households.
Our community deserves transparent, accountable, and responsive leadership. After careful consideration, we have concluded that the current five-member HOA Board has failed to uphold these standards and that the relationship with the current community management company, SBB Management, requires immediate reimagining or termination in accordance with the existing contract terms.
GROUNDS FOR REMOVAL
1. Lack of transparency. The Board has failed to provide timely, accurate financial reporting and has not made meeting minutes, budget records, or vendor contracts readily accessible to homeowners, in potential violation of state HOA disclosure laws.
2. Unresponsive governance. Homeowner concerns, maintenance requests, and formal inquiries submitted to the Board and to SBB Management have routinely gone unanswered or unresolved for unreasonable periods of time.
3. Mismanagement of community funds. The Board has not demonstrated responsible stewardship of HOA dues. Homeowners have not received adequate accounting for how assessments are collected, allocated, and spent, raising concerns about fiscal oversight.
4. Failure to maintain community standards. Common areas, amenities, and shared infrastructure have deteriorated due to deferred maintenance and inadequate contractor oversight, diminishing property values and quality of life for all residents.
5. Selective and inconsistent rule enforcement. HOA rules and deed restrictions have been inconsistently enforced, and in some cases, selectively, creating an inequitable environment and eroding trust in the Board's impartiality.
6. Failure to implement online meeting access. Despite repeated homeowner requests, the Board has refused to offer any method for joining the monthly meeting electronically, even though there is no Texas law prohibiting it. As a result, homeowner participation is not maximized, and awareness of concerns cannot be shared in a timely manner.
7. Inadequate oversight of SBB Management. The Board has abdicated its responsibility to actively supervise SBB Management, resulting in substandard service delivery, poor vendor coordination, and a management relationship that does not serve homeowners' interests.
DEMANDS
1. Removal of all five current Board members. We call for the immediate removal of all five sitting members of the HOA Board of Directors: [Kevin Juergen], [Jill Goss], [Adrian Wiley], [Wes Bourque], and [Meagan Maultsby].
2. Special election of a new Board. Upon removal of current HOA board members, a special election shall be held in accordance with the HOA Bylaws to fill five new Board seats, reflecting the diversity and interests of our community. Specifically ensuring equity by section, which means at least 1 member for each of the 3 sections and no more than 2 per section.
3. Full financial audit. The incoming Board shall commission an independent financial audit of HOA accounts, reserves, and expenditures for the prior three fiscal years.
4. Review the SBB Management contract in support of replacing the HOA management company. The incoming Board shall conduct an immediate review of the existing management contract with SBB Management and seek to terminate it, to be replaced by a new company already identified. The new HOA management company contract will begin based on the terms needed to exit the current contract with SBB.

I support the necessary changes in order to establish fair, equitable, and accountable representation, while assuring our HOA funds to allocated properly - which includes paying for specific performance, which has been overlooked with the retention of the current management team.
Our community needs a different administration company, that reduce our HOA fees

The board is not transparent and believes they have full power to do as they wish without zero accountability to the community and that is not true. The board talks down to community members and needs to remember they ANSWER TO THE COMMUNITY! It is not the other way around. They are elected officials and they can be unelected when they pull the crap that they do.
