To the Holding Village HOA Board and HOA Architecture Board:

The purpose of this petition is to request the Holding Village HOA board of directors and the architecture board to reconsider what constitutes the “Front Door” for the properties located on the lake behind the Holding Village Townhouses, specifically the townhomes located on Lilyquist Way, Wake Forest, 27587.

As you know, the HOA has a restriction for fencing one’s “front” of their dwelling to the use of a 3’ white picket fence. The HOA also allows dwellings to install a 4” black aluminum fence in their back yard.

Waterfront Dwellings:

The Board has designated the lakefront townhouses front to be that of the outside of their back doors, applying a commonly used practice of referring to dwellings facing waterfront to be the front of a dwelling. However, there are multiple examples of where is not required:

Examples:

The American Society of Landscapers Architects web site states “Waterfront properties can be considered the front door or the back door”.

Cambridge Dictionary defines a front door as follows: “The Main entrance to a building, especially a house, usually facing the road. “

Merriam-Webster defines a front door as follows: “The main entrance to a dwelling or apartment having more than one entrance: a doorway fronting on or giving direct access to a street.”

Consistency:

Considering the definition of “front door”, we believe the HOA restrictions are not being applied with consistency when it comes the townhouses on Lilyquist Way, requiring a 4’ aluminum fence for back yards on these properties would be consistent with the HV HOA guidelines.

Aesthetics:

Currently the only fencing in the Townhouse properties area are 4’ aluminum fencing, This includes the pool area, the retaining wall area. The sudden addition of plastic white picket fences would be inconsistent with what currently exists in this area and would be unsightly for all of the homeowners.

Safety:

The trail behind the HV townhouses is a beautiful sight for all the owners in the Holding Village community. However, only the housing area are currently being afforded the safety benefit of a 4’ fence. In speaking with multiple fence experts, all agree, a 3’ fence does not provide the same benefit as a 4’ foot fence. This is a concern for all of us townhouse owners that should be addressed with applying the HV HOA back yard rule.

In closing, we the undersigned residing on Lilyquist way, Wake Forest in Holding Village are requesting you apply the front yard designation to the entrance of our homes facing the road and allow the back yard facing the water to be treated as the other homes in Holding Village. This would allow us as homeowners the benefits of the HOA rules and a 4’ aluminum fence in their back yards.
