We, the undersigned homeowners of Goebel Crossings, support and approve an amendment to Section 10(A) of the recorded restrictions governing fence placement.


The purpose of this amendment is to establish clear and objective fence-placement standards that provide reasonable flexibility for different home designs and lot configurations, including homes with attached garages, corner lots, and angled homes, while maintaining the appearance and character of the neighborhood.


Current Fence Placement Restriction


Section 10(A) currently provides, in relevant part:


“All fences shall be located behind the rear building limit of the lot or the rear building limit of the adjacent properties.”


Proposed Amendment


The sentence above shall be replaced with the following:


All fences shall comply with one (1) of the following three alternative placement standards. Compliance with only one (1) standard is required:


1. Rear Building Limit Standard:

A fence may be located behind the rear building limit of the lot.


2. Adjacent Property Standard:

For a fence located on a particular side of a residence, the fence may extend forward on that side provided it does not extend forward beyond the rear building limit of the closest adjacent residence on that same side of the property. Only the adjacent property on the side where that portion of the fence is located shall be considered for purposes of this standard.


3. Architectural and Driveway Standard:

For a fence located on a particular side of a residence, the fence may begin at and extend from an exterior corner or exterior wall on that same side of the residence, including an attached garage, or from the point where a driveway or permanent paved surface meets that side of the residence.


Each side of a residence and each portion of fence located on that side shall be evaluated independently. The location, residence, or rear building limit of an adjacent property on the opposite side of the lot shall not be considered when determining compliance for a fence located on the other side.


The three placement standards are separate alternatives. A fence is required to satisfy only one (1) of the three standards. Satisfaction of one (1) standard constitutes compliance with the fence location requirement, regardless of whether the fence satisfies either of the other two standards.


Nothing in this provision permits a fence to violate any applicable governmental setback, right-of-way, easement, or other applicable law.


Effect of Amendment


All other provisions of Section 10(A), including the existing requirements concerning fence materials, maintenance, privacy fences, chain-link fences, barbed wire, woven wire, new materials, and maximum fence height, shall remain unchanged.

By signing below, I certify that I am an owner of property within Goebel Crossings and that I support and approve the proposed amendment to Section 10(A) stated above.

The language in the current bi-laws needs to be clarified and some flexibility is needed
