ATV/SXS Road Network Access for Queensland Recreation

Petition to the Commissioner of the Queensland Police Service

We, the undersigned ATV and Side-by-Side vehicle owners, club members, tourism operators, businesses and community supporters, request that the Commissioner of the Queensland Police Service address the lack of a clear and consistently applied QPS position concerning recreational ATV/SXS access to Queensland roads.

Conditionally registered ATV/SXS vehicles are used on roads by government agencies, councils, primary producers and other organisations. However, recreational clubs, tourism operators and individual owners face uncertainty and inconsistent decisions, even where:

  • vehicles are conditionally registered and insured;
  • proposed routes are suitable and limited;
  • councils and land managers have provided support;
  • appropriate licences, safety measures and operating conditions are in place; and
  • applicants are seeking organised, controlled and lawful access.

We are not seeking unrestricted road access. We are seeking a fair and workable process allowing properly managed recreational, club and tourism activities to be considered on their individual merits.

We therefore request that the Commissioner:

  1. nominate a senior QPS representative with relevant policy and decision-making authority to attend the proposed Cairns SXS stakeholder forum;
  2. ensure the representative can discuss solutions with TMR, councils, clubs, tourism operators and other stakeholders;
  3. clarify the written statewide QPS position on recreational and tourism use of conditionally registered ATV/SXS vehicles;
  4. ensure all applications are assessed consistently against legislation, TMR requirements, published QPS policy and objective road-safety criteria;
  5. ensure an officer’s personal opinion about ATV/SXS vehicles or recreational use cannot override the existing lawful registration and approval pathway; and
  6. give practical effect to the existing TMR pathway for safe, limited ATV/SXS road access, without additional local requirements or restrictions unsupported by legislation or written statewide policy.

Queensland ATV/SXS owners want to operate safely and lawfully. A clear and consistent statewide process would support responsible recreation, regional tourism and local businesses while protecting public safety.

By signing this petition, I support QPS participation in the Cairns stakeholder forum and the development of a fair statewide pathway for recreational ATV/SXS road access.

A workable compromise between the interests of SXS/ATV operators should be confirmed without discretionary ambiguity. Tourist dollars spent in these regions are considerable and safe and shared resource management can be achieved to help keep the regions alive.

We as a group from Tasmania have been on several trips with this company. Register our vehicles in Queensland on restricted recreational permits. We would like to continue doing this trip. Well to the future. Unfortunately our last trip the Queensland police officer went out of his way to destroy our trip which cost all of us thousands of dollars. This business is registered as a Queensland tourism operation yet the police went out of their way to stop it from happening.

Because people need to be able to have recreation, people need to have fun, people can't be locked in a box. Fun police need to be put back in the box they want to keep everyone else in.
