Committee members and fellow realtors,

We as members are asking that the policies regarding fines put in place in the Quincy Association of REALTORS®, Inc. Multiple Listing Service Broker-Load Policies & Procedures July 16, 2018 (Amended January 22, 2019, February 26, 2019 & September 24, 2019, January 28, 2020) be changed.

1) Appendix C MLS data policy and procedures pdf

2) Broker Load policies and procedures pdf

3) Appendix A Broker load agreement doc

4) Appendix B Prohibitive words

As members we are asking for an amendment to these documents to be made that requires the QAR staff to send the realtor member a warning of error that needs to be fixed by the end of business day instead of instant fines. As a member we strive to have all of our information accurate at all times but there is always room for error since the paragon system doesn't flag errors automatically such as prohibited words. We take responsibility as realtor members for our errors but ask that QAR work with us, not against us with instant fines. We as members understand that we can and will be fined after a warning if the amended changes are approved. As members we are also asking for transparency to where the money collected from fines is being applied. This needs to be part of the monthly reports with the committee. If there isn't a designated use for the fine money collected we would like there to be an option. The local QAR has a budget and this money should not be commingled with that budget.

Thank you for time to review our request.

Updates

April 16, 2020

The volume of support shows that the current fine structure is a widespread concern among our members. I have requested a formal meeting with the committee to present our proposed amendment and discuss the necessity of a warning system. We are now preparing a detailed report on fine allocation to ensure complete transparency.

Realtors have all been extremely upset about this n have said something needs to be done to correct this problem. A simple email giving us a day to fix the problem is the solution. Thank you.

I have received several fines in the last I have taken up for agreement and judgement was in my favor but the process was lengthy and took the time of way too many people including myself. So I simply paid them. I support this change. Errors occur no one is above them. Being notified and given time to make appropriate changes is the right way to operate.

I totally agree with this. The QAR should exist as support for brokers, not simply to police them.

Totally agree. We need a warning first and a time frame to make the correction
