Community Concerns Regarding the Proposed Parking Rule Changes

Otay Ranch Five Community

We, the undersigned residents of Otay Ranch Five, respectfully submit the following concerns regarding the proposed parking rule changes currently under consideration.

First, we recognize that parking challenges exist in certain areas of our community. We understand the Board's responsibility to address those concerns and support reasonable enforcement against vehicles that violate existing rules, such as abandoned vehicles, improperly stored vehicles, or vehicles that clearly do not belong in the community.

However, many residents believe the proposed changes are a one-size-fits-all solution to a problem that primarily affects only a small portion of our neighborhood. Many streets throughout Otay Ranch Five do not experience the same parking shortages, and residents in those areas have coexisted successfully for years without the need for overnight parking permits or the threat of towing.

The proposed rules would significantly change how every homeowner and resident uses public streets, regardless of whether their neighborhood has experienced parking issues.

Our Concerns

Community-Wide Restrictions for a Localized Problem

The parking challenges appear to be concentrated in specific sections of the community. Applying the same restrictions throughout the neighborhood imposes unnecessary burdens on residents who have not contributed to the problem.

Increased Towing of Resident Vehicles

One of our greatest concerns is the proposal that resident vehicles parked on community streets without a parking permit could be subject to towing.

Many residents believe that requiring homeowners to obtain an overnight parking permit to park on streets within their own community should only be considered where there is a demonstrated need. Applying this requirement community-wide is unnecessarily burdensome when many neighbors do not experience the same parking challenges.

The financial burden, inconvenience, and stress associated with towing could negatively affect responsible residents who simply need occasional street parking.

Existing Enforcement Should Be Demonstrated Before Expanding Enforcement Authority

Another concern shared by many residents is that the Association is proposing a significant expansion of its enforcement authority before first demonstrating that the existing parking rules can be enforced consistently, fairly, and uniformly throughout the community.

Before adopting broader restrictions, we encourage the Association to demonstrate that the current parking policies have been fully and consistently enforced and to evaluate whether improved enforcement of the existing rules may address many of the concerns without imposing new community-wide requirements.

Loss of Community Security

The proposed changes also include eliminating our current security guard services.

While security guards cannot prevent every crime, their presence serves as an important deterrent and provides visible security within our neighborhood. Many residents value this service and are concerned about losing an additional layer of protection while simultaneously implementing stricter parking enforcement.

Limited Community Awareness

Many homeowners have shared that they were unaware these changes were being considered.

Before implementing changes that will affect every household, we believe the HOA should ensure residents are fully informed and have a meaningful opportunity to provide feedback.

Suggested Alternatives

Rather than implementing community-wide parking permits and towing requirements, we encourage the Board to consider alternatives that address the problem where it actually exists.

These alternatives may include:

  Targeted parking enforcement in the specific areas experiencing chronic parking issues.
• Increased enforcement of existing parking rules before creating new restrictions.
• Enhanced communication with residents who repeatedly violate current parking regulations.
• Evaluating whether permit parking is only necessary in the affected neighborhoods rather than throughout the entire community.
• Gathering additional resident input through a community-wide survey or town hall before adopting permanent rule changes.
• Continuing the use of visible security services while exploring other parking solutions.
  
  

Our Request

We respectfully ask the Board to:

• Delay approval of the proposed parking changes until additional community input has been gathered.
• Consider targeted solutions instead of community-wide restrictions.
• Demonstrate consistent enforcement of existing rules.
• Preserve security services while evaluating parking alternatives.
• Work collaboratively with homeowners to develop a solution that addresses parking concerns without placing unnecessary burdens on the entire community.
  
  

Our goal is not to oppose change simply for the sake of opposition. We support reasonable enforcement and thoughtful solutions. We simply ask that any changes be fair, proportional, and reflective of the needs of the entire Otay Ranch Five community—not just one area.

Questions for the Board's Consideration

As residents, we are asking for the vote to be postponed, and we respectfully request clarification on the following questions before these proposed changes move forward:

1. What objective data supports implementing these parking changes community-wide instead of only in the areas where parking challenges have been identified?
2. What alternatives were considered before proposing a community-wide permit and towing program, and why were they not selected?
3. Before expanding the Association's enforcement authority, how has the Board determined that the current parking rules are being enforced consistently, fairly, and uniformly throughout the community?
4. How will the proposed changes impact our current security services, and what measures will replace the security guard presence if those services are eliminated?
5. How does the Board plan to ensure that all homeowners are informed and have an opportunity to provide input before a final decision is made?
