Void the Providence Golf Community 2020 HOA Meeting
Whereas, technical failures prohibited the free and uninhibited participation by members of the community in 2020 Providence Golf Community Homeowner's Association (HOA) meeting held by video conference on November 11, 2020;
Whereas, some members of the community who wished to attend were not granted access to the meeting without reason or cause;
Whereas, Florida Statute Chapter 720.306 states "When broadcast notice is provided, the notice and agenda must be broadcast in a manner and for a sufficient continuous length of time so as to allow an average reader to observe the notice and read and comprehend the entire content of the notice and the agenda," and;
Whereas, a detailed meeting agenda was not provided to members of the community, and;
Whereas, Florida Staute Chapter 720.306 further states, "Members and parcel owners have the right to attend all membership meetings and to speak at any meeting with reference to all items opened for discussion or included on the agenda. Notwithstanding any provision to the contrary in the governing documents or any rules adopted by the board or by the membership, a member and a parcel owner have the right to speak for at least 3 minutes on any item. The association may adopt written reasonable rules governing the frequency, duration, and other manner of member and parcel owner statements, which rules must be consistent with this subsection," and;
Whereas, individuals who wished to speak were not informed of this right by statute nor given this right by statute, due either to negligence or technical malfunction;
BE IT RESOLVED that the home and parcel owners of Providence Golf Community, and its subdivisions, do hereby demand that the Annual HOA Meeting held via video chat on November 11, 2020 at 10:30am, and any and all presumed decisions that were created, alluded to, or proposed be officially voided and nullified, and;
BE IT FURTHER RESOLVED, that the home and parcel owners of Providence Golf Community, and its subdivisions, do hereby demand that a new meeting be scheduled as quickly as possible and only after a successful technical test has been conducted which can ensure the efficient and equitable participation of community members, and;
BE IT FURTHER RESOLVED that the success of that test shall be measured by 1) the ability to to host up to 200 online participants, 2) the ability to build and monitor a queue for Homeowners to speak their questions and comments, 3) the ability to collect and disseminate written questions and comments from homeowners, 4) the ability for all participants to see and follow along with a distinct meeting agenda, 5) the a ability for all participants to be able to clearly see, read, and evaluate any documents, images, charts, or items of any kind that are discussed by the meeting hosts and presenters.
The Homeowners and Parcel Owners of Providence Golf Community demand notice of the above requested nullification within 10 business days of receipt of this signed petition, and a new meeting to be held within 30 days of nullification or before 12:00AM on January 1, 2021, whichever comes first.
