An Application (Docket 335) has been filed with the United States Bankruptcy Court, Southern District of New York, requesting authorization of Susan Hunt Levin as an Estate Representative for the Debtor for the purpose of obtaining share structure/share count information under the conditions that she pay all costs related to obtaining the information and, that once obtained, the information is appropriately treated in terms of its dissemination.
Obtaining the share structure/share count information is the only way the shareholders can document and determine the size and extent of the suspected naked short position.
To pursue any legal actions related to damages suffered by shareholders as a result of naked short selling, this information is required to prove the existence of the naked short position.
By signing this petition, I am indicating all of the following:
1. I am a shareholder of Spongetech Delivery Systems, Inc. with more than 100 shares of the company’s stock;
2. I believe that Spongetech’s stock and thus my investment may have been harmed by illegal naked short selling practices;
3. I support Susan Hunt Levin’s APPLICATION FOR AUTHORIZATION TO ACT AS AN ESTATE REPRESENTATIVE FOR THE DEBTOR FOR THE PURPOSE OF OBTAINING SHARE COUNT INFORMATION AND OTHER ATTENDANT DUTIES AS THE COURT SHALL DETERMINE.
