The proposed Ordinance 15 will take away the property rights of Boone County, Kentucky citizens by creating a 5-member panel with the ability to mandate how private property can be used. This Code Enforcement Board was proposed to deal with complaints from residents about unpleasant aspects of neighborhood properties. However, the forty-page proposed Ordinance 15 is riddled with property rights violations and ill-defined provisions that give the Code Enforcement Board free rein to do as it pleases to harass the citizens of Boone County.
Therefore, we demand that Judge/Executive Gary Moore and Commissioners Cathy Flaig, Charles Kenner, and Charlie Walton protect our property rights by rejecting Ordinance 15 and all similar proposals.
Some specific problems of Ordinance 15 include the following:
- The legions of enforcement officers this ordinance calls for (Sections 1 and 105.2).
- The nonsensically limiting codes pertaining to issues like house numbers and motor vehicles (Sections 204.3 and 202.10).
- The completely subjective codes about “security devices” and “discarded items” (Sections 204.18 and 108.3.3).
- The sections doing away with due process of law (Section 7).
- The abolition of the Fourth Amendment (Sections 106.3, 108.3.3, and 202.3.1).
- The ability of those enforcing the Ordinance to change the codes at whim (Sections 102.8 and 106.7).
- The fines for “incorrect” use or maintenance of private property (Section 10).
- The idea that government can dictate how private citizens use their property (throughout).
There are many more examples of the deep-rooted problems with Ordinance 15 that cannot be cited here for the sake of space.
The right to peaceful enjoyment of private property is the foundational right of this Nation, this Commonwealth, and this County. Like all rights, the right to property was not given to us by government and, consequently, cannot be lawfully taken away by government.
Suffice it to say that we, the undersigned residents of Boone County, Kentucky, oppose Ordinance 15 in its entirety and all similar pieces of legislation.
Therefore, we demand that Judge/Executive Gary Moore and Commissioners Cathy Flaig, Charles Kenner, and Charlie Walton reject Ordinance 15 and all similar legislation.

Our community is approaching the one hundred signature milestone. This level of participation is essential to show Judge Moore and the Commissioners that their current trajectory is unacceptable.

Having been born and raised in NJ, I purposely chose to live in an unincorporated area with no HOA to avoid these overbearing, big government laws. Gary Moore needs to go!
This thing reeks of government overreach and power grab. Notice how the fines for unapproved behavior can get jacked way up if you question them instead of complying. Disagree and you get punished for daring to speak up.
I am totally against this. I can't believe you would attack your farmers and people who have tried to preserve the history of this county. This is a total attack on our integrity!
Please vote against. Do not take away my right to own and live on my property as I choose. I don't want a Big Brother type environment. It's bad enough having the property evaluation people come on my property. If I want someone to come to my home, I send an invite. Basically government isn't invited.
Another layer of bureauracy which is not needed. Don't try to change the character of Boone County just to satisfy a few in the more affluent neighborhoods.
The Chamber of Commerce Vision 2015 promotes government regionalism as the driving force behind the eventual future consolidation and streamlining of local code ordinances and enforcement throughout Northern Kentucky counties. Fact: Kenton County has an established Code Enforcement Board. Regional Stewards such as a Judge Moore and others have made strong political commitments to advance this vision to eventually centralize all control of tri-county services under management by an unelected appointed Regional Governance Council whose members will represent constituents outside Boone County. Like Ms Jackson .... 100percent correct...The "vision" (which is well documented to the general public) is to manage and police the region like a sanitized HOA by business and local government leaders (Regional Stewards or landlords) that want to court, cater and accommodate the " global community" on behalf of creating future social benefits to be bestowed to our local residential property owners in our urban and rural communities. Needless to say..I personally do not see any benefits just infringements to my property and the way I live my life. I do not support Ordinance 15 and the establishment and creation of a a Code Enforcement Board.

I am completely against this ordinance. I choose not to live in a subdivision with an HOA dictating what can & cannot be done in my yard, or my home. I have worked 46 years & still working to have the home I choose to have without government interference.
