Ordinance 2019.1311 bans the sale of tobacco related items in the city limits, Kern County and Tulare County calls a ban unjust and unethical. This petition serves as a lawsuit against the City of Delano and the Mayor. In recent events Lawsuits againt New York, Michigan, Washington have been overturned by the courts. Our goal here is to stop the ordinance or to attempt to carve-out not a temporary stay but a grandfathered exemption.

The choices people make when they purchase tobacco products is not his choice nor is it his fault. He does not have the power to control what his consumers purchase and stripping away his products not only affects the community but his family as well.

They do not have the rights to ban tobacco products . As if it’s a personal choice if we smoke or not . The mayor are ruining family business by doing this .

Delano council members justification was based on their feelings as one member had said. They didn’t take facts and evidence into consideration. Also the claimed that CDC was still investigating the issue and now CDC has concluded that Nicotine vape products are not linked to the illnesses and deaths
