The 9 Orchard Hotel is located less than 200 feet from Yuan Tong / Cheng Chio Buddhist Temple, on the corner of Allen and Canal Streets (18 Allen Street / 61 Canal). Cheng Chio has served the community at this address for more than 20 years.
The Alcoholic Beverage Control Law prohibits certain licenses from being issued if the location of the establishment is on the same street and within 200 feet of a building that is used exclusively as a school, church, synagogue or other place of worship.
We, your constituents, submit this petition in support of a variance to New York State's 200-foot rule for 9 Orchard Hotel under the following terms which are different from the resolution voted on and submitted by Community Board 3:
- Neighborhood Restaurant & Bar (ground level, corner of Allen and Canal): 12am closure Sunday-Thursday; 1am closure Saturday and Sunday; one stand-up bar; no live music or DJs; no televisions; 97-person capacity.
- Hotel Dining Room (ground floor, Canal Street): 1am closure, no live music or DJs; no televisions; 78-person capacity.
- Hotel Lobby Lounge (ground floor, corner Canal and Orchard): 2am closure; one stand-up bar; no live music or DJs; no televisions; 65-person capacity.
We oppose a legislative variance to 200 Ft Rule if these terms are not agreed in full.

I have been spending my time reading through the notes you all have left about the temple and the quiet our neighborhood deserves. It is humbling to see that so many of you care just as much as I do about keeping these surroundings peaceful.

I am honestly a bit overwhelmed by the momentum behind this because I never imagined so many people would care about our neighborhood. This progress belongs entirely to all of you who took the time to speak up for our community.

finally some common sense. the area is changing and we should welcome good businesses that actually respect the rules.
SO TIRED of these blockages. leave the business alone, they clearly want to be good neighbors.
