As owners within the Meridian Private Residences Complex, we hereby direct our own HOA:
1. To immediate cease any and all activity with respect to proceeding with any current plan relating to the alleged construction defects and the tile flooring inside units and or on outdoor patios, and in particular:
b. As it relates to the awarding of any contractsc. As it relates to determining the course of action to replace or repair
2. To immediate form an independent home owners Construction Defects Committee dedicated to exclusively work with the current and newly elected HOA board and govern the proceedings of this matter on the following premise:
a. The Construction Defects Committee will consists of three (3) home owners who are in good standing with their monthly maintenance fees plus one (1) HOA Board memberb. Each Construction Defects Committee member will have one vote, the HOA board member will have no voting rightsc. All Construction Defects Committee decisions will be carried by majority voted. The immediate mandate of the Construction Defects Committee will be to:
i. Select a second opinion from an independent engineering company, as so chosen by the Construction Defects Committee, with the engagement of the engineering company to be to conduct a fully comprehensive, detailed, accurate and independent study and consultation of the load limits of the current construction and installed flooring, along with any subsequent proposed resolutions should any resolutions be requiredii. Review and select options to present to home ownersiii. Propose course of action with respect to the units in foreclosure
3. All HOA board decisions in this matter must be decided by a majority of the combined HOA board and the Construction Defects Committee.
4. Prior to commencing any actual actions that have a financial influence in any way (including but not limited to construction, legal proceedings, commencement of work), all final decisions must be approved by a referendum of all home owners in good standing, with a majority vote required to proceed, such referendum to be clearly worded and executed in accordance with the current HOA rules and regulations and as so approved by the combined HOA board and Construction Defects Committee.
