I, the undersigned, am a home owner/resident of Triton Homes Development more commonly known as Stone Creek Village. Stone Creek Village is located off North 168th and Kansas Street, Omaha, Nebraska. We Collectively request that the DECLARANT: Triton Homes, L.C., an Iowa Imitated liability company, doing business in Nebraska as TRITON HOMES, LLC recognize that they are in violation of Article 1.22 of the DECLARATION AND MASTER DEED OF STONE CREEK VILLAGE CONDOMINIUM PROPERTY REGIME, which states that Declarant Control shall commence sixty (60) days after the date by which seventy-five (75%) percent of the Units have been conveyed to Unit Purchasers. We are asking that the declarant, TRITON HOMES, LLC turn over all documents and accounting systems involving our Home Owners Association. This should include but not be limited to all back accounts, monies, receipts, contracts, and bills (past and present), correspondence and complaints. We also ask that any and all current board members as listed with the Nebraska Secretary of State submit letter of resignation so that the newly elected board may be recognized. We are giving the declarant, TRITON HOMES, LLC, until the 1st day of September, 2009 to turn over management to us, the home owners. We have come together for the good of all and are prepared to take over management immediately .
