In leading up to the events as they happened, Kingsville Memorial Funeral Home did not follow up per my contract with them. The contract was completed on Sunday, December 11, 2011. On Monday afternoon at approximate 3:30 PM, I met with the Manager of Chamberlain Cemetery, at 735 W Caesar Ave, Kingsville, TX. 

I ask the Manager, of the Cametery, as to why the entombment for Noelia had not been dug. His surprising response was that he had not been contacted by anyone all day, by any director from Memorial Funeral Home. I immediately requested that we go to the site and to bring all recorded records, such as legers, printed layout materials, Legal Survey (Drawings) which would show the plots paid for and how the four (4) plots paid by my parents were laid out.

After reviewing the inadequate hand sketches in an old ledger book, The Manager, was very confused and could not answer any questions. I challenged him with, due to the fact that no NORTH arrow was sketched, no one could determine the orientation of my parent’s plots, including the other staff  member, another representative of Chamberlain Cemetery Inc. The Manager and other staff member could not determine if plots were numbered left to right or right to left, which I then knew both were too confused and could not resolve the issue. 

My sister and I then decided to make a decision, to choose the plot were Noelia would be laid to rest. This was what then, my living Father wanted, after we lost our Mother. As a close nit family then, we did discuss all four plots to be used as any sibling should die before the rest. I wanted Noleia to be by my parents side, so I gave up my plot to her. It was my plot, I could do as I pleased.  I wanted her to be close to my Mother and Father.

Due to time constraints, the Manager, wanted to delay the digging, because two (2) staff members had just gone home for the day. I then called The Director of the Funeral Home, with Kingsville Memorial, to come immediately and negotiate any additional expenses incurred by Chamberlain Cemetery Inc, which concerned the Manager .  *This caused unreasonable infliction of mental or emotional distress. All was settled and work commenced immediately.

Never did the Manager, call any director members of Chamberlain Cemetary. You would think if I was disputing anything he was presenting to me, He would have called. It is the Manager, which is a representative of Chamberlain and the lack of the Cemetary that did not represent to me at the time, any legal binding ledgers, sketches’ or drawings of sort, that could prove the correct numbering of the plots.  The responsibility soley lies on Chamberlain Cemetery Inc., not it's staff members. 

The Manager and the other staff members final words were they are all paid for.  It really does not make a difference.

Then, I ask myself as to why did Danny; have two (2) plots in his name. when each of the siblings’ should have their own. It is he at some point decided of the 4 plots who gets what, without consulting with us. This I see where Danny, brother (Disowned by Family and relatives’) again, after “purchasing” them, not “paying” for them with his own money, manipulated, what was originally agreed by, all surviving siblings. This was done accourding to the deeds on, the 30th of December 1996 and the 15th of January 1997, soon after my Mother passed away, and only he had possession of the deeds.  He did this at the Kingsville Court House, when signing documents, and or had Chamberlain Cemetery write up without our consent, what he thought benefited him at the time. Each sibling should have their own Deeded plot. That is what my Father wanted.

Once again this shows the fraudulent business practices, as we have witness before.

On Wednesday December the 14th I get a call from a staff member that works for the Cemetery and asked that I call Mr. Hunter, a board of director to Chamberlain Cemetery. I ask, is there a problem. He replied that Danny contacted them and said that he paid for the plots. Arturo Gonzalez Jr. oldest brother (Disowned by Family and Relatives’) was seen Surveying the grave site on the 12th.  When conversing with Mr. Hunter he asked if I could come by and bring all documents. I ask if there was a problem. He said there is a dispute and as a director he would  have to determine and resolve what Danny was contesting. At this point he is in very much in contact with Danny. Any documents I have, he can certainly obtain from the Kingsville Court house, or Danny can give him copies. As I calmly told him, to tell Danny, all parties will be hearing from my attorney. Mr. Hunter’s tone of voice, choice of vulgar langue demonstrated his incompetence as a director. It is he that is trying to defend himself, from his incompetents, inefficiencies, unethical, business practice. *This also caused unreasonable infliction of mental or emotional distress.

I cut my trip short as I headed back into Houston, and on Monday, had to see my Doctor, as I was eduring to much pain and suffering, along with emotional distress.

My mother-law, survivor of a heart attack, two (2) years ago and taken to the hospital for another scare, just after Noelia's Passing, on Saturday December 17th does not need any more emotional stress.

February 3, 2012

Sam Fugate Attorney that represents Chamberlain Cemetery sends me a certified letter stating they intend to bury (exhume) my wife Noelia and move her to section J, Lot 150, Space four (4) OR five (5). He presents NO Legal Survey (Drawing) to where She is NOW, and to be moved to. She currently is buried in lots belonging to your brother Daniel. I ask how they can belong to Daniel solely. Those lots are in Lot 18, Section J, Spaces one (1) and (2), again where is the Legal Survey (Drawing). Sam Fugate tells me, we regret having to do this, but your representation to our staff is quite frankly what caused this error.

Sam Fugate only adds insult to injury by telling me "my representation caused this error", but he in his letter to me, only admits they made a mistake, in the past and present and how the Deeds were written in the first place, with NO Legal Survey (Drawings) .

The De La Paz Family, and David Gonzalez, will be petitioning.   WE will be having prayer vigilance in Memory of Noelia.  All the dates and locations to be announced in the near future. Please contribute to the cause. We thank you for all your Prayers, support and concerns.

To DATE as of May 25th,  Sam Fugate Attorney that represents Chamberlain Cemetery has admitted they have made a serious mistake in the interment of Noelia.  Further litigation is pending.
