ENERGENCY ACTION

KIOWA INDIAN COUNCIL EMERGENCY ACTION AUTHORIZING THE REMOVAL OF THE RECALLED KBC MEMBERS OF THE JULY 16, 2011 SPECIAL RECALL ELECTION.

WHEREAS, The Kiowa Tribe of Oklahoma is a Sovereign Nation from time immemorial, and is a Federally Recognized tribe possessing inherent sovereignty, and

WHEREAS, The Kiowa Indian Council has the Right and Responsibility to ensure safety and all protections to the Kiowa Tribe as a whole and pursuant to the Kiowa Constitution under ARTICLE I. Section 2. Kiowa Indian Council (KIC) The Governing body of the Kiowa Tribe, and

WHEREAS, The Kiowa Indian Council will exercise the Rights of the Governing body of the Kiowa Nation under ARTICLE V. POWERS. Section 5. RESERVED POWER CLAUSE and support the said action of this petition signed by Kiowa Indian Council (KIC) members,giving their authority tosupport to finalize this action, and

WHEREAS, The Kiowa Indian Council being the Governing body of the Kiowa Tribe confirm that the Special Recall Election was in fact held and votes were cast giving the only certification needed pursuant to the Kiowa Constitution and Bylaws. The Kiowa Indian Council agrees that the vote is valid and will stand, and

WHEREAS, The Kiowa Indian Council agrees and stands firm that pursuant to the Kiowa Constitution ARTICLE V. POWERS Section 5. Power Clause. Any right and power heretofore vested in the Kiowa Indian Tribe but not expressly referred to in this Constitution SHALL NOT BE ABRIDGED by this article, but may be exercised by the members of the Kiowa Indian Council. By this Article, all powers NOT expressly vested in the Business Committee are reserved to the Kiowa Indian Council, and

WHEREAS, the Kiowa Indian Council feels it necessary this action is taken and demand that all other Kiowa entities and all outside entities to include the BIA and the Federal Government acknowledge this action, and

NOW, THEREFORE BE IT RESOLVED, that the this matter be brought to conclusion so that the Kiowa Indian Council can assure the safety, security, and stability for the Kiowa Peoples future, and the action of removal be taken and the Recalled KBC members be officially removed out and away from the Kiowa Complex and banned forever from being involved in any Kiowa Tribal business ever again.
