Our brother Fraser Hodge was murdered in cold blood by another human being, the result of violence for violence sake. Frasers murderer was refused bail on three occasions but on appeal at the High Court in Edinburgh bail was granted without any special restriction or conditions. The assailant promised he would not be a risk to others, nor approach any witnesses or kill again. He also promised to turn up for his court appearance. Bail was granted on these statements alone. This was despite bail being vigorously opposed by the PF, the crown and the sheriff on three occasions. We, the Scottish people are a generous peolple who are respected throughout the world. We are a passionate, loving and caring people and yet this killing exists within our society and amongst our own. It has to stop and stop now. This man enjoyed Xmas with his family and friends. He is able to walk the streets, travel abroad and move freely between any country. It could be two years before he goes to court, There was no Xmas for us, only crying and sadness, he killed our brother the week before our mother died and it broke her heart. We buried them together on the 11th December 2009. The whole family is broken, swallowed up in an abyss of pain and sorrow. Wife, Nieces', nephews, brothers, sisters, daughters and sons trying to come to terms with this insurmountable loss. In the eye of the law, the assailant is innocent until proven guilty hence he is entitled to bail. Bail should be refused for crimes such as this. They know he murdered, they know he used a weapon on Fraser's neck and he admitted killing him. Anybody who uses a knife, a bottle or a weapon of any sort against a human being should refused bail. They should go straight to jail - no questions asked! If it was up to me I would cut their hands off! Vengeance and retribution are powerful emotions that can only be tempered by justice but our justice system lets us down. We talk tough but do nothing, it is time for change! We know we need to understand the causes of crime but deterrents are needed now - action is needed now - it's time to be tough on crime!
