PETITION TO GOVERNOR JB PRITZKER
Calling for Repeal and Rewrite of the Pretrial Fairness Act
We, the undersigned citizens of Illinois, call on Governor JB Pritzker to immediately assemble a bipartisan task force to address the failures within the Pretrial Fairness Act.
TASK FORCE MEMBERSHIP
- State Legislators – to craft and pass balanced laws
- Law Enforcement Officials – to share on the ground experience and observations
- State’s Attorneys & Prosecutors – to ensure effective and realistic prosecution policies
- Defense Attorneys & Legal Experts – to protect due process
- Victims & Victim Advocacy Representatives – to center the voices of those harmed
WHY THIS IS URGENT
- The Act ties the hands of police, prosecutors, and judges — preventing them from detaining potentially dangerous individuals long enough for a proper initial investigation to take place.
- The elimination of cash bail has weakened the justice system financially. Bail once supported court operations, public defenders, and victims’ restitution. Now, taxpayers shoulder the growing costs of pretrial services, including monitoring programs that provide little real accountability.
- Defendants on pretrial release often receive curfews and monitoring, but these are not actively enforced. Illinois allows up to two days per week with no monitoring, and long curfews are credited day-for-day against future jail sentences. This loophole can result in offenders serving no real time for serious offenses.
REAL LIFE CONSEQUENCES: The Megan Bos Case
Megan Bos disappeared under suspicious circumstances, and her cause of death remains undetermined almost 6 months after her remains were found on private property in a garbage can containing bleach.
The primary suspect, Jose Mendoza Gonzalez, admitted to destroying valuable evidence as well as leaving Megan in the garbage can for 51 days…causing her body to be severely decomposed upon discovery. Despite not knowing how she died or the circumstances leading up to her death, Mr. Mendoza Gonzalez was released in less than 24 hours, back to the crime scene, under a curfew with no active monitoring.
His immigration status could not be considered a flight risk, and the destruction of evidence carried no consequence under current law.
This case sets a dangerous precedent: a suspect may destroy critical evidence in a suspicious death and still walk free without meaningful restrictions. Read Full Text here
OUR DEMANDS
We respectfully call on Governor Pritzker and Illinois lawmakers to immediately:
- Repeal and rewrite the Pretrial Fairness Act.
- Restore judicial discretion so judges can detain suspects when necessary.
- Reclassify serious offenses to close dangerous loopholes.
- Consider a fair and manageable cash bail option that sustains courts, funds public defenders, and supports victims.
- Address the hidden costs of pretrial services, ensuring taxpayers are not forced to fund ineffective monitoring in place of real accountability.
Illinois deserves a justice system that protects communities, supports victims, and ensures fairness without sacrificing safety.
