PETITION TO MANAGEMENT, ROBERTS COMMUNITIES & VILLAGE FARM

Petition Summary and Background:

  • Plans provided residents in lots 141, 142, 143, 144, and 145 clearly identified the area between the these lots and Canoga avenue as without Park Model RVs (Enclosure 1)
  • During lot selection/purchase, the aforementioned area was communicated to potential residents by Village Farm staff both through document (Enclosure 1) and verbally as a green space "pocket park" without Park Model RVs.
  • By reserving and purchasing lots 141, 142, 143, 144, and 145, residents accepted the aforementioned offer at the terms and plans identified.
  • Only afterall lots have been secured and residents moved in did Roberts Communities act in bad faith and execute a bait and switch to plan to place Park Model RVs in this space.
  • This change was never communicated or discussed with residents. It was only identified in new maps (Enclosure 2) which were placed by sales staff on utility boxes. Only upon residents expressing their concern did sales staff confirm the updated plans.
  • These lots were never set up for utilities or other residential infrastructure.
  • This unacceptable change to place Park Model RVs on the lots, if Village Farm proceeds:
    • Prevents residents of lots 141-145 from removing their Park Model RVs (e.g. legal property) at the termination of their lease with Village Farm.
    • Exacerbates mail delivery issues on Farm Side Phase 1.
    • Exacerbates existing parking shortages on Farm Side Phase 1 by adding two new resident parking spot for which parking was never permitted/built.
    • Sends a clear message to Phase 1-4 residents on how Roberts Communities operates in bad faith.

We, the undersigned Residents of Village Farm Phase 1, petition Roberts Communities and Village Farms to:

1. Honor original promise/communication and retain the area behind lots 141-145 as community green space/pocket park (Enclosure 1).

2. Do not permit or build this space for Park Model RVs.

3. Do not place/sell these lots as Park Model RV spaces.

4. Retain the capability of impacted residents to remove their Park Model RVs.

During the sales process, I was driven by this piece of land and saw people doing aerobics classes. I was told that outdoor gym equipment would be installed and that they would not be putting homes there.

The the area to remain clear area behind lot 143 was a significant factor in our decision to purchase our home in this community. We questioned the sales staff member about the possibility of homes being parked in the area adjacent our bedroom patio and were told this area would remain green. We are holding the villiage Farm decision makers to this promise NOT to park more homes in our back door. A community fire pit or picnic area would serve the residents much better in such an area.

Though I knew about the 2 houses directly behind me, the space in question was open and green when I bought mine. I would not have picked my lot had I known it would be completely boxed in. The site map should be honored as it was.

Lot #145: Lot was chosen specifically for capability to relocate it upon my termination of stay at Village Farm. This future intent to remove my RV was explicitly communicated to sales staff during lot selection. If Roberts Communities proceeds, I will have to pursue other recourse regarding this matter.
