Opposition to Approve Re-Zoning Application Z-12 for Richard Duncan Land Investments, LLC
To the Homeowners of Highland Ridge,Highland Pointe, The Grove and MountainCreek EstatesSubdivisions, Collectively further referred to as theCommunities of Mountain Road
This petition serves as the collective voice of the homeownersof the Communities of Mountain Road,expressing opposition to the proposed rezoning of the lots 3665 Mountain Rd, Marietta GA 30066(currently zoned R-20, 1.83 Acres) and 3675 Mountain Rd, Marietta GA 30066 (currently zoned R-30, 2.592 Acres).
We stand that the current zoning of the 2 lots should togetherbe zoned R-30 as the larger track of the property is zoned as such. While the proposed rezoning from R-30 & R-20 to R-15 will have direct effects to the immediate surrounding lots of the property in Highland Ridge, andadverse effects to the neighboring communities will results as well. It is important to the Communitiesof Mountain Road that we have representation of unified support/or majority for our immediate neighbors and surrounding neighbors as a whole.
We ask for your signature of support for the following Motion to Deny and Motion to Approve, acting on behalf the Communites of Mountain Road.
MOTION to DENY: We request that Board of Zoning for Cobb County DENY Richard Duncan Land Investments, LLC the following:
Rezoning of the 2 lots: 3665 Mountain Rd, Marietta GA 30066- (currently zoned R-20 with acreage of 1.83 acres) and 3675 Mountain Rd, Marietta GA, 30066 (currently zoned R-30 with acreage of 2.592 acres), together totaling 4.422 acres.
Proposed setbacks of Frontal being 35 Feet, Rear 30 Feet.
Proposed lot density increase to 2.04
MOTION to APPROVE: We request that the Board of Zoning for Cobb County and Richard Duncan Land Investments, LLC accept the following proposal on behalf of the Homeowners of Highland Ridge subdivision:
Lots 3665 & 3675 Mountain Rd, Marietta GA 30066 be zoned for R-30 as the majority of the property is currently zoned as such
Property setbacks be contiguous with recent development Mountain Creek Estates having setbacks approved by the county of Frontal 25 feet, Rear 45 feet
Maintaining a lot density that is also contiguous of surrounding neighborhoods density as well as the Future Land Use Maps of Cobb County and Development Standard and Ordinance of VLDR being 0-2 dwellings per acre. (Mountain Creek Estates has a lot density of 1.15)
Richard Duncan Land Investments, LLC to provide the surrounding properties (lots 73-94 of Highland Ridge) with a “green screen” landscaping buffer consisting of specimen grade hard wood trees, Leyland cypress or like
Proposed community to construct an exterior perimeter community privacy “wall” constructed of brick or stone or combination with minimum height of 8 foot
Proposed houses to be constructed of minimum 3 side brick or stone or combination of the two, with a minimum square footage of 3,500 sq feet per house with minimum starting price of $550,000 with the house style consistent of surrounding subdivisions ie: The Grove, Highland Pointe, Highland Ridge, and Mountain Creek Estates
A pedestrian sidewalk be installed on both sides of the proposed entrance of the development adjoining the existingsidewalks already in place at both entrances of Highland Ridge

I am concerned about traffic, having a road in my back yard, construction noise, run-off from the road, maintenance of the strip of land between the road and the back of the homes, street lights in both front of houses and now back of houses, the discrepancy of home sizes between the zoning app and what we've been told verbally. These issues must be addressed to our satisfaction to gain concurrence
The following discrepancies stated between HOA President Highland Ridge and Richard Duncan: What Richard told HOA Presiden Kiffer Andress: - Houses are at a minimum 3,000 sq. ft. while most will be around 3,500 sq. ft. or larger - Price range is $550,000-$650,000 - Craftsman style homes What was actually printed on the application with the County: Houses minimum of 2,400sq feet Price Range $450,000-$550,000 Craftsman style: brick, stone, batten board, shake or combination thereof
NO!!!!!!!!! Area is already over crowded. Lot is too small for this number of proposed homes.

Mountain road is already dangerous- notorious for speeding. This road needs HUGE speed bumps and better striping. The intersection at Mountain Road NE and Sandy Plains is dangerous and needs a red light. Home styling and zoning should be consistent with the surrounding area.
