Hand Over Austin Common HOA to the Homeowners.

The majority of the current residents are concerned about the community and feel that the community is not getting the proper attention that is needed from the current HOA.

During the HOA annual meeting several concerns were made known but homeowners still feel that the current board is not acting in the best interest of the Homeowners.

Per the Declaration of Covenants, Conditions and Restrictions (aka CCR’s) under Article II, Section 2 states:

Voting. The Association shall have two (2) classes of voting membership:

  1. Class “A”. Class “A” Members shall be all Owners, with the exception of the Declarant and the Builders/Owners. Class “A” Members shall be entitled to one (1) vote for each Lot. When more than one (1) Person holds an interest in any Lot, all such Persons shall be Members. The vote for such Lot shall be exercised as they determine, but in no event shall more than one (1) vote be cast with respect to any Lot.
  2. Class “B”. The Class “B” Members shall be the Declarant and their respective successors and assigns and the Builders/Owners. The Class “B” Members shall be entitled to three (3) votes for each Lot owned. The Class “B” membership shall cease and be converted to Class “A” membership on the happening of either of the following events, whichever occurs earlier:
  1. When the total votes outstanding in Class “A” membership equal the total votes outstanding in the Class “B” membership;

ii. Ten (10) years from the date this Declaration is recorded in the Gwinnett County, Georgia records (January 8, 2008);

iii. When, in its discretion, the Declarant chooses to terminate the Class “B” membership by filing of record with the Clerk of the Superior Court of Gwinnett County, Georgia, a written notice of such termination.

Per the above definition of the CCR, item (i) should now apply.

We are asking that the management of the HOA/Community be handed over to the homeowners at this time.
