PETITION: Formal Request to Rescind Business License & Investigate Environmental Vandalism

FROM: Residents and Property Owners of Marloth Park

SUBJECT: Rescission of Business License for Kruger Park Hostel due to persistent nightclub-like noise and Investigation into Environmental Violations

1. Statement of Purpose

We, the undersigned residents and property owners of Marloth Park, hereby formally petition the Nkomazi Municipality to rescind the business license of Kruger Park Hostel, 313 Varing Street. This request follows three years of persistent noise violations and anti-social behaviour that contravene both municipal by-laws and the unique environmental regulations of Marloth Park.

Furthermore, we demand a formal investigation into the unauthorized vandalism of municipal parkland and protected flora by the establishment.

2. Record of Persistent Noise Violations (Feb 2023 – Feb 2026)

Despite numerous direct appeals from neighbours and interventions by the Community Policing Forum (CPF), Kruger Park Hostel has demonstrated a total disregard for the "Quiet Zone" status of Marloth Park. The signs at all the entrances to Marloth Park say no loud music, Marloth park is a conservation area. The ethos is of nature and tranquillity as the same owners advertise for their other property Ungava Retreat/Rosendal. To quote the website “Amidst the tranquility of Ungava Retreat…”

The disturbances include:

  • Nightclub Activity: Regular use of amplified music with heavy bass ("doef-doef"), professional DJ mixing, and loud karaoke sessions.
  • Disorderly Conduct: Consistent shouting, whooping, and screaming at the outside entertainment area associated with drinking games.
  • Operating Hours: Disturbances often continue into the early morning hours.

Evidence Timeline (Excerpts):

  • Aug 25, 2023 (01:00 AM): Drunken whoops and party games audible from indoors.
  • Sept 17, 2025 (21:27): High-volume music/shouting in a designated nature area.
  • Feb 4, 2026 (23:00): Continuous nightclub-style music and drunken revelry.

(A 5-page record of noise disturbance over the past 3 years is attached.)

3. Environmental Vandalism & Illegal Land Use

We call for the Municipality to charge the owners/employees for the following actions on municipal parkland:

  1. Illegal Trail Cutting: Laying a private trail through public municipal land without authorization. Despite being told by the Nkomazi Rangers that they could not do this, they wilfully re-cleared the path recently.
  2. Vandalism: Defacing natural rocks and trees with 70+ yellow paint splotches.
  3. Protected Species Damage: The unauthorized cutting of branches from a nationally protected tree, (Diospyros mespiliformis) a criminal offense under South African environmental law.
  4. The unauthorised trimming and cutting down of trees and bushes on Parkland, illegal in Marloth Park.

4. Demand for Action

As ratepayers, we request that the Nkomazi Municipality:

  1. Revoke the trading/business license of Kruger Park Hostel due to the failure to adhere to land-use conditions.
  2. Conduct an onsite inspection of the municipal land bordering the property to assess environmental damage, and if any laws have been broken to lay a charge against the offenders with the SAPS.
  3. Enforce strict fines for all breaches of bylaws.

it is meant to be a quiet place for wildlife not a party spot. we moved here for the peace and quiet and these people just dont care.

The noise is absolutely ridiculous. Cant even enjoy a braai on a Saturday without that thumping music going until 3am. Enough is enough.

Living next door to this has been a nightmare for three years. The municipality needs to do their job and enforce the by-laws.
