The Town of Hammond planning board recently approved the construction of a slaughterhouse on 54 Dubois Road directly adjacent to 2 residential properties. This decision was made without due consideration of application errors nor amendments contained in the 1992 Hammond Site Plan and Subdivision Review Law. As a direct consequence, property owners, the environment, and quality of life have been placed in jeopardy. The interest of every citizen should be protected and no one should be jeopardized as a consequence of a benefit to another

Specifically we contend that:

Due to the recent approval by the Hammond Planning Board of a Slaughterhouse in the middle of a previously considered “Residential Neighborhood," we the undersigned, as property owners and individuals with legal standing in the Town of Hammond, do herein make the following requests by petition in accordance with Article I, Section 1.6 - Amendments of the 1992 Hammond Site Plan and Subdivision Review Law and seek immediate action by the Hammond Town Board and Hammond Planning Board for protections as follows:

  • Identify all residential properties and group them into a set of “neighborhoods” based on defined boundaries for the neighborhoods.
  • Implement adequate and reasonable land use regulations, including setbacks, as allowed by NY State Law, to protect adjoining residential properties, year-round homes, seasonal homes, and neighborhoods. Such regulations shall protect the neighborhood's residents from non-residential use, flooding, erosion, traffic congestion, extreme unsightly design, noise, odor, exterior lighting, signage, air pollution, water pollution, and the erosion of the identified neighborhoods predominate characteristics and land values.
  • Develop and empower a Community-involved residential Site Plan Review mechanism to allow affected adjacent propriety owners a voice in any planned or proposed deviation from Residential Property use.
  • Implement an immediate moratorium on all non-residential site plan evaluations, building permits, and new non-residential construction in the Town of Hammond, until such time as the Town has instituted adequate and reasonable Residential Property protections. Such protections should: a) anticipate, for example, future requests for activities such as a pig farm, sawmill, slaughterhouse, junkyard, hazardous chemical storage, etc., and b) consider the impacts of non-residential development on each residential neighborhood’s quality of life, well water, and other environmental conditions.
