Petition for a Perimeter Fence

Black Diamond Property Owners Association, Inc.

The undersigned members of the Black Diamond Property Owners Association, Inc., [hereby the Members] petition the Board of Directors [hereby the POA] to pursue the construction and maintenance of a chain link fence. Specifically, the fence should provide a barrier along the southern and eastern boundary due to the recently approved development of commercial and residential housing along those adjacent areas

  1. The fence should be at the least a 6 ft high chain link that would match the existing fence along the northern and west boundary of Black Diamond.
  2. An estimate has been obtained from a local fence contractor [estimate is attached to the email]. The cost for approximately 10,000 linear feet is $100,000.00. Survey and minimal clearing will need to be done. The overall projected cost would be approximately $150,000.00. Additional quotes need to be received by Board.
  3. Exploring methods of paying for the construction of the fence whether through borrowing money or using funds in the reserve of the POA or other sources. The owners of the golf course should bear the responsibility for their portion of property which represents approximately 3000 LF.
  4. Holding a special meeting of the POA Board to discuss the results of this action, no later than April 25, 2023.

This addition is imperative to retain the sense of security for all residents in Black Diamond. 18 months ago there were two criminals at large, who entered Black Diamond along Shadow Creek Road, and were being chased by police for several hours after a car theft incident at the YMCA and Walmart. With a new shopping center being constructed at 491/486, multiple businesses and large residential area - leaving the adjoining boundary of Black Diamond open as in its current state will subject residents to this becoming a more common issue. Our community will be more at risk for crime and/or uninvited individuals to easily wander in.
