The owners of 9266 Par Court of the BackNine Subdivision rent their house on AirBnB. Rental is $149 to $179 per night, no minimum stay, advertised as suitable for up to 16 people per night. There is a constant parade of renters, often with eight to ten cars and trucks in the street and driveway and garbage left for days in the street, usually overflowing. There is loud noise, drinking, and pot and cigar smoking on the terrace. Besides uncountable family/college/other reunions and parties renters (that we know of) include a high school football team, a stag party, a group of 8 men from Pennsylvania attending a convention, and a band. There is no regard whatsoever for the safety of the children on our cul de sac, or respect for the privacy and rights of the other families on the street. There has been vandalism. They do not have a county permit.

CC&Rs and By-Laws provide for “residential rentals”, which infers longer term rentals, but does not specifically prohibit nightly or short term rentals. At the moment, this appears to be the only house in the BackNine that is being used as a hotel, but it could happen right next to you, changing forever the wonderful residential neighborhood we all have chosen to live in. We therefore think it prudent to take action as a body and strongly urge the Board Members to change the CC&Rs and By-Laws before this gets to be more than an isolated problem.

Once the Board makes a proposal for a change in CC&Rs, we will be required to vote on the amendment, with a 2/3 majority of members voting "YES" to make the change. This petition is the first step in a lengthy process, but if we come together we can preserve our neighborhood.

PETITION TO BAN NIGHTLY & SHORT-TERM RENTALS IN BACKNINE HOA

We, the undersigned, members of the BackNine HOA at Jeremy Ranch, do hereby urge the Board of Directors to take the necessary steps to ensure that nightly rentals and rentals of less than two (2) months duration be prohibited in the HOA. Rentals of two months or more would be allowable to single families or to a limited number of people sharing a house. House exchanges for vacation purposes could be allowed provided the exchange was with a single family. (PLEASE ADD ADDRESS TO COMMENT SECTION)
