We received approval by the ACC to build a private deck off of our master bedroom. The ACC log has our name, address, applied for and approved to expand patio and build upper deck. Three months after we received our approval we started to build our deck. One neighbor called the management company and complained about our deck invading her privacy. It is hard to invade someones privacy when you live on the green belt with wroght iron fences and two-story houses all around you. This neighbor has continued to push the issue until a lawsuit ensued. We were never at any time contacted by the ACC only the management company. Even though they know that we have approval the HOA continues with the lawsuit. It has cost us $15,000 so far in attorney fees. That is not counting the attorney fees to the management co. They also want us to pay fines not to exceed $200 a day from the day we applied for the deck which was on 2/3/04. As of now we are on the court docket for Sept 11,, 2006. The sad thing is that we as homeowners have to pay for this lawsuit on both sides. If we win we pay. If we lose we pay. We would like the HOA to put a stop to this before it costs us all a lot more than it already has. We are homeowners who live in The Villages of Woodland Springs and are being sued by the HOA which is controlled by the developer. He also controlls the ACC which approved our deck.
