For years, the Tucker Cemetery located in Searcy County, Township 15-N Range 17-W section 15; has been off-limits to family members due to the lack of access to the cemetery by landowners. The access is blocked by locked gates and the inability to access via car. If a gate happens to be unlocked, it requires the individual to use a ladder to climb the fence to access the cemetery. This leaves many individuals that will never be able to access in the current situation due to age or disability. This is a dishonor to those buried, their memory and their legacy. Failure to have consistent access has resulted in the cemetery falling into disrepair and overgrown with vegetation. A group of family members have been working to restore the cemetery, but failure to have appropriate access has made the job immensely more difficult.

The family members of individuals buried in Tucker Cemetery are seeking permanent access without having to go through locked gates and No Trespassing signs. We are asking that the access to Tucker Cemetery be permanently granted in accordance to Arkansas Cemetery Access Laws 2017; 5-39-212; Arkansas Code 2010; 14-14-812 and Act 1286 of 1997 Senate Bill 482. Cemeteries—access: (a) (1) It is unlawful for any person, firm, corporation, partnership, or association to construct any fence on any property in such a manner as to enclose any cemetery, graveyard, or burying place unless reasonable access by automobile to the cemetery is provided by gate or otherwise. The continued denial of access to (Tucker Cemetery, located in Searcy County) has prohibited family members from access to the burial sites of their family members; and has prevented regular maintenance of the cemetery.

The under signed United States citizens acknowledge we have family member(s) buried within Tucker Cemetery, located in Searcy County. The under signed citizens are asking that permanent access be established to the Tucker Cemetery, located in Searcy County. Access must be in accordance with Arkansas Cemetery Access Laws 2017; 5-39-212; 14-14-812 and Senate Bill 482. Which states; (Access to a cemetery must be accessible by automobile).

The momentum behind this petition proves that people are fed up with these landowners blocking families from their own ancestors. We are forcing these people to acknowledge that they cannot simply gate off history to suit their own convenience.

I recently encountered an extremely rude man who wanted to stop me from visiting the place where two of my cousins' ashes remain on private land once owned by my family atop Petit Jean Mountain. You have my sympathy. Arkansas law needs to be clearer about perpetual family access to the resting places of their loved ones.

They should be able to have access even if that means make them a road. They just want to take care of the cemetery there should not be any issues with them. As long as they are responsible and respect your property what's the big deal. Surely an arrangement can be made to peacefully resolve this matter.

I have family buried in the cemetery and would love access to do regular maintenance to being my family's headstone from disrepair. Along with helping keep the ground maintained

The Tuckers buried in this cemetery are my family. Granting access to the cemetery is the right and decent thing to do.
