move the parkway parking inland
We call upon the Supervisors of Santa Cruz to move the 5 parking spaces at the "Dirt Farm" inland and return the open space and ocean views. Request to the Santa Cruz Board of Supervisors, to relocate inland, the planed 5 parking spaces in the coastal view, in public open space, on fill, on a coastal bluff, that covers a willow grove, between 36th Ave and 37th Ave on the land traded by the County with O’Neill to preserve his front yard. Where as Under General Plan (GP) 5.10.1 Local Coastal Plan (LCP), Designation of Visual Resources …define visual resources as… vistas from designated scenic roads… Where as 5,10.2 (LCP) Development Within Visual Resources Recognition that visual resources …include…ocean views… Requires projects to be evaluated against the context of their unique environment…and design to protect these resources… Where as 5.10.3 (LCP) Protection of Public Vistas Protect…by minimizing disruption of landforms and aesthetic character caused by grading operations…structure design Where as 5.10.10 (LCP), Designation of Scenic Roads, County Road East Cliff Dr from 33rd Ave to 41st Ave is a Scenic Rd. Where as East Cliff Dr between 36th Ave and 37th Ave is a Scenic Rd that has an ocean view and needs to have that view protected from development that is not quality design Where as The Public Easement By Prescription, is acquired by continuous, uninterrupted, exclusive use that is open and notorious and adverse under claim or right, was heard in Gion v. City of Santa Cruz (Cal. 1970), applies in this instance Where as Implied Dedication was found in Gion v City of Santa Cruz (Cal. 1970), that property is dedicated by showing acquiescence of the owner. Also shows why this property is undeveloped, due the continuous use by the public. Where as The people who use this land called for a public meeting to request that this land not be used for a parking lot amoung other concerns. Where as there are many areas on the inland side of East Cliff Dr that would be in keeping with the General Plan and Local Coastal Plans Goals and objectives to preserve and enhance our Coastal Corridor Therefore We call upon the County Supervisors to stop 5 parking spaces in this environmentally sensitive location and relocate the 5 parking spaces inland. If implemented in a timely fashion, public funds will be preserved with a less expensive inland alternative. The funds preserved, will be better used to remove the fill in open space and use it for the fill need for the rest of the Parkway project. Please move forward with all due speed and seek permission from any other relevant agancies, County or State, to implement a Change Order, to create a more environmentally sound project.
