Put the neighbor who was agitating him down instead or make him pay a fine or community service....this dog should not be harmed in any way.

There have been tons of cases where people hated their neighbour's pets and tried to get them removed or even worse, by resorting to killing by themselves.
The neighbour who has tried to agitate the dog multiple times should be brought to justice and please dismiss the nonsensical charges against the dog and the owner.
