This is a petition to have the case of Rocky A. Pearson re-opened and Watauga County Sheriff Department investigated for failure to properly investigate the death. The Sheriff's Department on January 25, 2009 @ 3:36 am enters the apartment of Rocky Pearson and Allyson Elmore located on RC Cook Rd. Boone, NC where Rocky was found with a Gun Shot Wound to the Head in his bedroom floor. Besides Rocky and Allyson there were four other individuals at the apartment at the time of the incident and only three of those individuals were put on the Sheriff's Incident report. The only eyewitness in the room at the time of death was not even listed on the report. The five people at the apartment were told by the Sheriff's investigator to sit down in the living room and write down the events of the evening. None were ever questioned after that as far as we know. The lead investigator told the parents that suicide would not be on the death certificate and it was considered an accident and yet that is exactly what was placed on the death certificate. Now that tells the parents that when they left the apartment that morning they had already decided in their minds it was a suicide and nothing more. The question remains why the first EMT on the scene was sent away and another called no more than 123 minutes after that. Both EMT reports state something different. Also why was the scene given the ok to be cleaned that same day; in which the cleaning crew showed up by twelve noon that same day My sons body lay at the hospital morgue from Sunday to Tuesday before the ME Dr. Hall ever looked at the body; and why wasn't the ME on call, Dr. McCoy, not sent out to the scene of the crime to release the body in person. No ME was called to the scene and the Sheriff Department has yet to explain why that is. As parents we are looking for answers and justice for our son and Watauga County has denied us answers. It makes us wonder how many other parents are not satisfied with what they were told about their childs death since Sheriff Hagman and his investigator have been on that office. Now as parents we are pleading with the Attorney General & the public to compel the Watauga Sheriff's to let us have copies of all the documents, videos, statements and anything else pretaining to Rocky's case.  We believe that Rocky's case files shouldn't be govern under NC GS 130-1.4 since by NC Law Suicide isn't a crime, in which is how it is listed or as the Sheriff's told us they made no call in his case.  By letting us have a copy of what the Sheriff's have will help us figure out what happened to our son that night.  As parents we should have the right to know what happened to our son.
