In June, the HOA board sent a set of rules to homeowners outlining that there is antiharassment policy for the board, management, and set forth rules to participate on their new HOA facebook page. The duties of the board are
1. Duty of loyalty which requires HOA board members to act in good faith to promote the best interests of the entire association. HOA board fiduciary responsibility are to prevent board members from making decisions to further their personal interests.
2. Duty of care which requires HOA board members to make informed decisions regarding HOA matters.
3. Act within the scope of their authority. They cannot act or make decisions on matters that are outside the boundaries of their roles and HOA responsibilities to homeowners
Per the amendmement to the property owners act in 2021, it is within a homeowners’ legal right to change the association's rules and regulations. Homeowners can choose to take action if they deem certain rules as unfair, outdated, or discriminatory.
A few homeowners met with the city of Hampton on 7/23/24 and was told information that do not align with what the board has relayed to the community over the years. The HOA president relayed to some they did not receive authorization to meet with the city and attempts have been made to gag those who attended.
When moving into an association, the premise is there is structure among the community and being a part of an association adds to one's value. It was never presumed that homeowners would be subjected to a need to know budget or projects and create rules to dictate how they interact with one another.
Sign this petition to repeal the rules that were sent out in June and to tell the board of directors to allow the homeowners who attended the meeting with the city, to share with the community what they learned.
