Any hardening of the shoreline on or below the primary dune is detrimental to the natural dune ecosystem.
No compromise! The sea wall must come down! If not, builders, homeowners will continue to build illegal sea walls without consequences.
This seawall appears to encroach below the Ordinary High Water Mark and thus is built on property owned by the State of Indiana. Did they obtain a DNR permit to build this?
If this wall is not removed, the next time the lake encroaches and the beach retreats, we will have a contained cesspool behind what remains of the wall - and a severe public hazard.
Enforcement of local, county and state regulations and ordinances is NOT discretionary unless the appeal process is followed and hardship is proven. To "negotiate" the placement of this seawall will weaken the entire regulation for the governing body and place those involved subject to misconduct claims.

I beleive the Long Beach Community Alliance to petition the court to allow us to intervene as a party to this lawsuit in order that we might assert unique defenses that we as residents of the Town of Long Beach can only assert. These defenses include the unique and historic relationship that all resident of Long Beach have enjoyed for generations in their use and enjoyment of the entire beachfront in Long Beach.
