Hi again,

I'm sure you’ve seen the most recent email from the HOA. It stated that the recent ballot would not be taken into consideration due to not receiving a majority of ballots to proceed with a vote. The board has re-sent the ballot in hopes of getting a better response.

Every person that I have spoken with regarding retaining our right to rent out our vacation homes/cabins has stated that they want to retain that right. Several owners did not respond but everyone that did (except one owner that was undecided) voted "no" on this restriction.

Recently, Justin Hobbs sent out an email requesting that we discuss this in the upcoming board meeting rather than in a mailed-out ballot. I completely agree and am writing you now to ask for your help in encouraging the board to wait until then to make any major changes. Both Justin and I have requested we wait until the meeting, but the board has been unresponsive. Would you please take a few minutes out of your day today to sign this petition to postpone any decisions until the upcoming meeting in July? I don't wish to put words into anyone's mouth.

I'm trying to maintain a positive outlook on the dealings I have had with the HOA board but am having difficulty with that. My emails and calls were responded to promptly when there weren't any disagreements between the board and my family. Since the concerns arose, I have been all but ignored. I find this odd, unprofessional, and frankly, somewhat underhanded. Based on some of your responses, this isn't uncommon when someone disagrees with the HOA board. That's certainly not to say the entirety of the board is aware of this, but certain members undoubtedly are.

Please help us not only retain our rights on this issue but ensure that any potential concerns in the future will be addressed in a fair manner that respects the opinions of the residents within our HOA. We purchased our cabin in hopes of having a peaceful place to relax, go fishing, and enjoy the beauty that Strawberry has to offer. We don't mind having an HOA to help maintain our cabins and respect our neighbors and fellow cabin owners; however, the HOA is currently crossing that line into infringing on our rights as homeowners.

Please understand that this is only a petition to allow us to be heard at the meeting before a decision is made. It is by no means a binding decision in either direction. Thank you for your consideration in this matter that is so important to all of us.

This just seems ridiculously and intentionally sneaky on the board’s part. They are so obviously disregarding the cabin owners’ opinions that it’s just offensive. What is the point of an HOA if it isn’t to do what the people within it actually want? We need to talk about this at the meeting IN PERSON (because clearly, the board won’t communicate honestly through mail or email) that way we can gather all the information from both sides, then make educated decisions from there. It isn’t fair at all for the HOA to sneakily trick us owners into their own agendas.

We would never have purchased our lot if nightly rentals weren’t allowed. Other people likely won’t purchase in a development that doesn’t allow rentals. By prohitibiting nightly rentals, you are in fact decreasing the value of our property.

I believe that the HOA board has gone too far this time. They (or some of them) seem to be trying to smuggle their agenda into our laws, avoiding “due process” and bypassing homeowners who disagree with that agenda. This is an example of how a Kangaroo Court operates. My husband, Curt Porritt, purchased our property at Strawberry Lakeview Estates with the express intent of sharing the joy and beauty of the place with as many as possible. This vision not only included friends and family, but also over-night renters. Unfortunately, he passed away of a sudden heart-attack a year ago, while doing what he loved best; fishing at Strawberry. He was unable to see his dream fulfilled for very long. Not only would we like to continue this legacy in his honor, but having over-night renters is the only way that we can continue to afford to do so. Homeowners have rights that HOAs should both acknowledge and protect. This requires mutual respect from both parties. This includes consistency, honesty and transparency on both the parts of the Homeowners and the Homeowners Association. We, at Strawberry Lakeview Estates, are no exception to this.

I find it disturbing that the board is making changes that were not in the lawers overview! You are asking for a blowup at the meeting

The board should have the decently to present the proposed changes before the owners of cabins and lots during the annual meeting. Instead they have tried to pull a sneaky and have a vote before the people were properly informed. What the board has done is not in the best interest of all owners. I think they should all be booted because of the poor lack of leadership in behalf of the people.

I would like to discuss some of these issues at the next HOA meeting to get the feelings on these matters from the other property owners!
