Johnson County has removed all restrictions. My attorney friend sued the county and the governor and won both cases easily because they both clearly violated ordinances, statutes, laws, the KS Constitution, etc. Now I’m being unduly infringed upon by my own HOA who decided to jump on the bandwagon of overreach. Enough is enough. It’s time to go back to doing the American thing and let personal choice and personal responsibility rule rather than a select few on power trips. If someone has a problem with going to the pool, then don’t go...

While some groups would still be better off distancing, there are lots of our neighbors that could be in fresh air and use the pool safely. If you want to limit numbers a bit or have alternate times, that could be considered but the pool still needs to open.

I totally disagree with the decision to keep our neighborhood pool closed for the season. We should be the ones to decide for ourselves and our children whether the pool is safe to visit or not. That decision should not be solely made by the HOA.

We, as adults, should be allowed to decide whether we and/or our children will be going to the pool this summer. We are all fully aware of the risks. We make choices like this every day when we leave our houses. This decision, should be ours to make, not the HOA board.

Bentwood Park has opened their pool and has posted a very well thought-out sign with their guidelines. I am sure we can mimic their guidelines. We think since the decision to keep the pool closed is something that affects ALL of the owners, there should be a full HOA vote of some sort. We are very pleased this petition was started. Those who wish to use the pool should have the option, and those who do not want to take the risk, can stay home.

The pool should be available for those who choose to use it and those who are uncomfortable doing so may exercise that right not to go. We are adults and should be trusted and allowed to make decisions about our own health and well-being independently. It's an outdoor area with sunshine and chlorine. The risks are minimal.
We would be happy to sign a waiver or release agreement so that the HOA would not be responsible for any COVID (or other) damages as has been suggested by others in this petition. Thank you.

Pool needs to open as normal. Can understand not having movie night or Socials if they have concerns otherwise individuals can decide for themselves to use something we pay towards. No concerns for liability, as I would not hold liable if get a sunburn while at pool etc....Do not overthink or overreact, just open!

By signing this agreement, I acknowledge the contagious nature of COVID-19 and voluntarily assume the risk that my family, including child(ren), and I may be exposed to or infected by COVID-19 while on site at the pool and that such exposure or infection may result in personal injury, illness, permanent disability, and death. I understand that the risk of becoming exposed to or infected by COVID-19 at the pool may result from the actions, omissions, or negligence of myself and others, including, but not limited to, the HOA Board and pool management company's employees, volunteers, and program participants and their families. I voluntarily agree to assume all of the foregoing risks and accept sole responsibility for any injury to my child(ren) or myself (including, but not limited to, personal injury, disability, and death), illness, damage, loss, claim, liability, or expense, of any kind, that I, my family and my child(ren) may experience or incur in connection with my child(ren)’s attendance at the pool or participation in pool activities (“Claims”).
