The Petition of certain citizens living in the State of New York and residing in Community Board 3 oppose the liquor license application for Stanton BSB LLC d/b/a Martine as applied: small shared plate "restaurant", 4 floors (cellar, ground, mezzanine, 2nd floor), 155 persons (39 tables with 142 seats and 1 24 Ft standup bar with 11 seats), 2am closure (Sun - Sat, DJs, live music, garage doors, 2 tv monitors, and security.

We, the petitioners who live in close proximity of this application, are already negatively impacted by existing traffic conflicts and congestion, parking difficulties, excessive noise, raucous and antisocial behavior, and suffer compromised public safety and health resulting from living in an area with the highest alcohol-outlet density in the City and State of New York.

Martine will be situated in one of the most problematic sections of Hell Square surrounded by problematic, large occupancy and/or high impact (ie DJs, cabarets, live music, multiple tvs for sports viewing, etc) venues:

  1. Hair of the Dog (217 Ft, 1 minute away, 259 Occupancy, 4AM, 17 TVs + 3 Projectors, Open Facade)
  2. Pizza Beach (203 Ft, 1 minute away; 182 Occupancy, Loud Music, 2AM, Open Facade, Sidewalk)
  3. The Skinny (207 Ft, 1 minute away; 139 Occupancy, 4AM, DJs, Open Facade, Wait-lines)
  4. 82 Stanton fka Epstein's (243 Ft, 1 minute away; 74 Occupancy, 2AM Open Facade, Sidewalk)
  5. Arlene's Grocery (82 Ft, 0 minute away; 116 Occupancy, DJs, Live Music + Shows, Open Facade, Wait-lines)
  6. Indigo Hotel / Mr. Purple (246 Ft, 1 minute away; 489 Occupancy in Eating & Drinking + Pool, 2AM + 4AM, Rooftop, 3 Bars, Wait-lines)
  7. No Fun (131 Ft, 1 minute away; 150 Occupancy, DJs + Comedy Shows, 4AM, Open Facade, Wait-lines)
  8. Piano's (141 Ft, 1 minute away; 297 Occupancy, 4AM, DJs, Live Music + Shows, Open Facade, Wait-lines)
  9. Kind Regards (220 Ft, 1 minute away; 214 Persons (Applied PA), DJs, Live Music + Shows, Open Facade, Wait-lines)
  10. Local 138 (315 Ft, 1 minute away; 74 Occupancy, 4AM, TVs)
  11. Sixty LES (354 Ft, 1 minute away; 608 Occupancy in Eating & Drinking + Pool, 4AM, DJs, Live Music + Shows, Rooftop + 2nd Floor Terrance, Wait-lines)
*Also Rockwood Music is housed in same building with entrances on Orchard and Allen; 4AM closure, wait-lines and 365 Occupancy)

Moreover, Jon Gabel who has presented himself to the public as a creative force and GM of "Martine", but who will not be on the license, has an extensive nightlife background:

  • J.l Sullivan, "Upper East Side college-type bar" (NYT); 1994
  • Mantra Nightclub, 28 East 23rd Street; 1997
  • Nightclubs: Snitch later named Cintrine at 59 West 21st Street, 2004-2010
  • Porky's Bar later named Bounce Sports Bar, 2003 - 2010
  • Nightlife Promotions, Packages & Ticket Sales (on or before 2009 - Present):Skynet Media Group, Joonbug.com, NewYears.com, NewYearsEve.com, HalloweenParties.com, BarCrawls.com, CraveTickets.com, LindyPromotions.com

This is cause for grave concern and closer scrutiny, especially since he has sold tickets, promoted parties and hosted pub crawls at many of the most problematic venues in the Hell Square, which be breaking stipulations and /or method of operation if not been permitted to use outside promoters, sell tickets or host events: The DL, The Delancey, Son's of Essex, The Skinny, Hotel on Rivington, Sixty LES, Libation, etc.

There is no public convenience or benefit in approving this license where there exists up to or more than 43 liquor licenses within 500 ft, including hotels with multiple bars / lounges and eating and drinking , and entertainment venues. Moreover, the GM and Creative Director's extensive nightlife background makes this project highly risky to this community that is already suffering from nightlife saturation blight and compromised quality of life and public safety.

I live right next door and the noise is already unbearable. Do not add another 155 person venue to this street
