Goal: To ensure Holland and Barrett honour our orders for 'Serious Mass' protein. On March 28th 2012, Holland and Barrett priced Serious Mass protein (Strawberry) for £3.29 on their website. A number of people then purchased this item and took advantage of their buy one get second half price offer. Confirmation emails were received by those who purchased and we were notified that the products will be dispatched within 48 hours. The monies were then debited from our accounts for the protein ordered. We were then notified by Holland and Barrett via email that they were having 'availability problems' with the product and the orders are cancelled. In conjunction with this the product status on line was changed to 'out of stock'. Yet to our amazement, the product status was changed back to 'available' a mere 2 hours later of the cancellation email, but at a price of £32.99. Now if there was ever an insult to their customers' intelligence this is one; to suggest that this was an availability issue is outrageous and we will not pay for your pricing errors! And to uncover this further, point 5 b) of Holland & Barrett's terms and conditions states, and I quote, "we will confirm acceptance of your order by e-mail to the address you have given and the sending of this e-mail (whether or not it is received) makes the contract between us". Therefore, they are now breaking a binding contract with their customers since we have received confirmation orders via email. To add to this, under section 6 a) Holland and Barrett quote "the price of the products will be the price quoted in the Web Site at the time we accept your order. The price will include any applicable value added tax, but not the cost of delivery"; this, therefore, is further evidence of another breach of the contact they have made with us. To wrap this up, Holland and Barrett you must accept your mistakes, accept that this was an outrageous way to cover up your mistakes and outrageous disregard to customer service, and accept that these orders must be honoured. If you are affected by this, please show your support and follow this petition. We will get our protein we have purchased delivered.
