A disproportionate sentence is a sentence that is greater than one the charges call for. I was convicted of 4 counts of Felonious Assault, and sentenced to 35 years in prison. Only one person was injured, and no one died. As a rule, Felonious assault carries only 2 to 8 years in prions, and I have already been incarcerated for 20 years. Convicted murders have spent less time behind bars than this.

I am in no way attempting to mitigate what the victims of this crime have gone through. I have more than paid my debt to society and was both serious and vigilant with my personal rehabilitation efforts. I am simply asking the court to demonstrate mercy, because I really need to be with my children, grandchildren and family. At some point, such lengthy sentence becomes cruel, inhumane. Especially when it has such an adverse effect on my innocent children and family.

This petition is an attempt to rectify a severely disproportionate sentence by asking judge Kathleen Ann Sutula of the Cuyahoga County Court of Common Pleas to reconsider and reduce the 35-year sentence. Ultimately, allowing me to return home to be with my grandchildren, children and family to support them emotionally, environmentally, psychologically, and financially, and to be a productive member of society.
