COLES CROSSING COMMUNITY ASSOCIATION, INC.

PETITION FOR A CALLING OF A SPECIAL MEETING OF THE MEMBERS

This document shall serve as the Petition by at least twenty percent (20%) of the members of Coles Crossing Community Associations, Inc. The signatures of the Members included and attached to this document presented to the President of Coles Crossing Community Associations, Inc. requires that the President call a Special Meeting of the Membership of Coles Crossing Community Association, Inc. for the below-described purposes, within thirty (30) days of receipt.

Article II (D) of the Amended and Restated By-Laws of Coles Crossing Community Association, Inc. states, in part: “[I]t shall be the duty of the President to call a special meeting of the Members of the Association […] upon a petition signed by Members representing at least twenty (20%) of the total Class “A” votes of the Association.”

Therefore, a petition calling for a Special Meeting of the Members of Coles Crossing Community Association, Inc. is effective with signatures from twenty percent (20%) of the Members of Coles Crossing Community Association, Inc.

Further, Article III, Section A (5) of the Amended and Restated By-Laws of Coles Crossing Community Association, Inc. states: “Any director may be removed, with or without cause, by the Members at a meeting called for such purpose.”

As directed by this document, the Special Meeting of the Members of Coles Crossing Community Association, Inc. shall be held on: _____________________, 2017 at ___:00 p.m. at the address of ________________________________________________.

The purpose of the Special Meeting of the Members of Coles Crossing Community Association, Inc. is as follows:

1. Conduct a vote for the Removal of the Directors of Coles Crossing Community Association, Inc., including Nathan Hurt, George Valdez, Larry Gaithe, Ralph Ellis, Ronnie Lopez and any other Director(s) not listed.
2. The election of a new Board of Directors for Coles Crossing Community Association, Inc. to fill any vacancies created by the removal of the previous members of the Board of Directors.

By signing below, each of the undersigned Members of Coles Crossing Community Association, Inc. acknowledges that they are record fee owners and Members of Coles Crossing Community Association, Inc. in accordance with Article V of the Articles of Incorporation of Coles Crossing Community Association, Inc. Further each of the undersigned Members’ signatures affirm that individual’s formal written demand and petition that the President of Coles Crossing Community Association, Inc. call a Special Meeting of the Members as set forth herein.
