
A PETITION BY THE PEOPLE OF THE STATE OF NORTH CAROLINA REGARDING GOVERNOR PAT MCCRORY AND ATTORNEY GENERAL ROY COOPER


A PETITION BY THE PEOPLE OF THE STATE OF NORTH CAROLINA REGARDING GOVERNOR PAT MCCRORY'S AND ATTORNEY GENERAL ROY COOPER'S REFUSAL TO UPHOLD THE CONSTITUTION OF THE STATE OF NORTH CAROLINA
WHEREAS, Article III Section IV of the North Carolina Constitution states: "The Governor, before entering upon the duties of his office, shall, before any Justice of the Supreme Court, take an oath or affirmation that he will support the Constitution and laws of the United States and of the State of North Carolina, and that he will faithfully perform the duties pertaining to the office of governor"; and
WHEREAS, Article III Section V, subsection 4 states: "The Governor shall take care that the laws be faithfully executed."; and
WHEREAS, the people of the State of North Carolina voted by majority vote to amend the Constitution, known now as Article XIV Section 6 to read: "Marriage between one man and one woman is the only domestic legal union that shall be valid or recognized in this State. This section does not prohibit a private party from entering into contracts with another private party; nor does this section prohibit courts from adjudicating the rights of private parties pursuant to such contracts."; and
WHEREAS, Article I Section 2 of the North Carolina Constitution states: "All political power is vested in and derived from the people; all government of right originates from the people, is founded upon their will only, and is instituted solely for the good of the whole."; and
WHEREAS, on Friday, October 10th 2014, a United States District court ruled outside the jurisdictional authority on the matter when declaring the amendment to the North Carolina Constitution as unconstitutional; and
WHEREAS, Article I Section 6 of the North Carolina Constitution states: "The legislative, executive, and supreme judicial powers of the State government shall be forever separate and distinct from each other." and Article 1 Section 1 of the United States Constitution states "All legislative Powers herein granted shall be vested in a Congress of the United States, which shall consist of a Senate and House of Representatives.", and neither grants any authority to any judicial office the power to legislate; and
WHEREAS, North Carolina Governor Pat McCrory and North Carolina Attorney General Roy Cooper have publicly declared that they will not uphold and defend the North Carolina Constitution by complying with the decision of the federal court, thereby violating their oaths of office;
NOW, THEREFORE, BE IT RESOLVED by the undersigned on behalf of the People of the State of North Carolina that:
Governor Pat McCrory and Attorney General Roy Cooper shall either immediately uphold their oaths of office by defending State law and sovereignty, or resign from their positions immediately.
Upon refusal to resign or acknowledge this petition by either official, we also petition the North Carolina House of Representatives to move for impeachment in accordance with Article III Section 3, subsection 5, and Article IV Section 4 of the North Carolina State Constitution.
