PETITION TO CANCEL THE FIBERNOW CONTRACT

     We, the undersigned members of Pelican Landing Community Association Inc., pursuant to our
rights under Florida Statutes Chapter 720 and the governing documents of our Association, hereby petition the Board of Directors to call a meeting of the membership for the purpose of voting on the cancellation of the following contract:

Contract Description:

•    Vendor/Service Provider: FIBERNOW
•  Date of Contract: Board Vote to Approve July 20, 2026 (Signature Imminent)
•  Summary of Services/Obligations: FIBERNOW Contract – New Term 11.5 years beginning       on or after June 1, 2028 and ending on December 2039.

Reason(s) for Cancellation:

Lack of membership approval, ignoring membership direct pleas to not switch from HOTWIRE, flawed financial analysis, open “subject to change” fees that may be added, 11.5 length of contract term, flawed analysis of comparison of technology, misrepresented comparisons leaving out key elements and making improper comparisons to others, unnecessary disruption of the PLCA community and its members, and lack of transparency in the process.

We hereby request that this matter be placed on the agenda for the next regular or a special meeting of the membership, and that proper notice be given in accordance with Florida law and our governing documents.
