We, the undersigned, representing Towing and Recovery owners and operators in Wyoming, do petition the Joint Transportation, Highways and Military Affairs Interim Committee to consider the following input prior to moving forward on any legislation or regulation governing the towing and recovery industries within the State of Wyoming. A) Committee should allow input and involvement from the industry to acquire a better understanding of all the components involved in the towing and recovery industry and how it affects billing practices to our customers and clients. B) Committee should study the number of non-consent tows and recoveries within Wyoming and make a fair comparison to the number of complaints filed against the industry within the same time period. Justify the true need for regulation of the industry based on these findings. C) Committee should not infringe or expand upon existing FFA, USDOT or other Federal rules and regulations that the industry is currently held to abide by. D) Committee should not infringe on the right to free enterprise and fair competition by setting price caps upon the industry. E) Committee should allow for stakeholder participation in the draft of any legislation concerning the industry to be regulated. Committee should make proper notification to stakeholders prior to any meeting schedules concerning legislation that will govern the industry. As well, should allow for stakeholder participation in the resolution of disputes and complaints filed against owners and operators within the industry. F) Committee should allow time prior to legislative action for the industry; to present standard operating practices held by stakeholders, to present operating cost and profitability and how legislation may affect such. We, the undersigned, petition the Joint Transportation, Highways and Military Affairs Interim Committee to seriously consider the concerns of the Towing and Recovery Owners and Operators of Wyoming in regards to the pending legislation.
