
Child Welfare Services-Chula Vista Wrongful Removal of Jeremiah Rivera.


We, the undersigned, are writing to express our strong support for Jennifer Parkinson and to stand against the wrongful removal of Jeremiah Rivera (3yrs old) by Child Protective Services (CPS) of Chula Vista by Social Worker Marielena Lozano on 11/13/2024. This action was taken based on Jeremiah having a Presumptive Positive screening drug test, which was later confirmed by a confirmation drug test to be NEGATIVE and has caused significant emotional distress to Jennifer Parkinson and Jeremiah Rivera, as well as to his siblings Faith, Benjamin, Kaleb and the family as a whole. The case originally opened due to a video sent to CPS were Jennifer is getting her air pulled by her husband while her son Jeremiah was watching. They made such a big deal about the dv in the video but then later on ended up dismissing it and with the new petition which is this “ positive “ drug test (actually NEGITIVE) …Jeremiah misses his mom Jennifer and siblings so much and his mom and siblings wouldn’t want nothing more then to have Jeremiah home were he belongs.
**Unfounded Allegations:** Jennifer Parkinson is a loving and responsible parent who has always prioritized the well-being of Jeremiah Rivera. The initial removal was based on a presumptive positive screening drug test followed by a confirmation drug test resulting as negative. A personal friend of Jennifer’s has also reached out to her stating that the exact same worker with exact same agency did the exact same thing to her and her son just only a year and a half ago.
**Confirmation Test Results:** Importantly, the subsequent confirmation drug test came back negative, clearly indicating that the presumptive positive was not valid. This evidence supports me our assertion that the removal was unjustified nor was it mentioned in court once the results were in.
**Health Concerns for Jeremiah Rivera** On 01/14/2025, during one of mom’s visits, she discovered that Jeremiah Rivera has been suffering from a severe diaper rash and an allergic reaction to what she recently found out a allergic reaction to amoxicillin. No one called Jennifer Parkinson to rule out what he could of ate that made him break out in hives. The diaper rash was not being treated nor did he have any ointment which lacks the appropriate care and attention Jeremiah Rivera needs. This situation then leads to Jennifer asking for the medical records for Jeremiah Rivera. She’s then told that she’s not able to access the records and how she’s not even a contact on Jeremiah Rivera’s health chart.
**Violation of Constitutional Rights:** Furthermore, CPS has failed to ensure that Jennifer Parkinson has access to Jeremiah Riveras medical records, not being notified of any hospital visits or check ups, which is a violation of constitutional rights. This lack of access has severely hindered ability to defend against the allegation or health concerns
**Impact of the Removal:** The removal has caused significant emotional turmoil, disrupting the bond between Jennifer Parkinson and Jeremiah Rivera negatively affecting the overall well-being of his siblings and family.
We are asking for the immediate reinstatement of Jeremiah Rivera to Jennifer Parkinson’s custody. It is our belief that Jennifer Parkinson can provide a safe, loving, and nurturing environment for Jeremiah Rivera, and that the basis for the removal is both unfounded and unjust.
Call to Action
We urge you to take the following actions:
1. Review the circumstances surrounding the removal of Jeremiah Rivera, particularly the validity of the drug test results.
2. Address the constitutional violation regarding access to medical records.
3. Act swiftly to return Jeremiah Rivera to Jennifer Parkinson
