Wellington Woods HOA lawsuit over pool cabana addition

The cabana is beautiful! The HOA needs find another way to spend their time. We don’t need any more harassing, stalking and discriminating neighbors than we already have.

I live here 46 years one of the first to build I also have been down that road with the HOA and Town of Weddington. It’s how some are targeted and some get away within their own.

To Anonymous You seem like an angry man/woman. Page 22 from the wellington Hills booklet states that pool structures are allowed. Why are you doing this? the HOA agreement you noted is outdated from 2003, theres been a updated document in 2009.

What about fixing the street light in front of my home that has been out for the past 4-5 months and maintaining the rusted maiboxes instead of spending the abundant reserves on litigation? Is the Board also going to go after the people who have installed wooden fences?

This is a ridiculous lawsuit. Can no one use common sense? This obviously improves the value of the home and the community. Do we need an election to remove from office the officers who believe this is a good use of our fees?

Jan, I don't know where you should send your email. I would think the "right people" to review your displeasure with this lawsuit would be the officers of the HOA. Unfortunately, I don't know who they all are either. Sorry, I am not very helpful. I think it is interesting that those who think this is a bad idea are all taking responsibility for their comments, but those that support the litigation choose to remain anonymous. Truthfulness and transparency are fundamental when building trust. It may be unfair, but those in positions of authority have to be held to a higher standard of accountability. Maybe we are expecting too much out of the HOA leadership when we expect them to protect our property values, and be good neighbors at the same time.

Section #32 is extremely clear on who has to pay for any litigation, the lot owners, not the association.

Such a waste of HOA funds. The Cabana is a beautiful addition.

If the HOA regulations really say you can have a pool equipment shed, isn't "pool shed" and "cabana" just a matter of semantics? Why would officers of the HOA waste money on a lawsuit if this type of "structure" is allowed in the bylaws? Obviously the pool was approved at one time, so common sense says there will be a "pool shed" type of structure. Other comments say there are already pool sheds with other pools in the neighborhood! Why toy with association members if the mission statement is to "improve the value of properties" - 'cause that is one good looking pool shed. If plaintiffs sign a complaint that has no merit, isn't there some recourse in the courts to prevent this type of legal harassment? Based on the facts as presented, it looks like those who signed this complaint and are prosecuting this litigation are opening themselves up to some exposure under Rule 11 sanctions. Aren't we all adults here? Jeez - one of the mission statements is: Be a good neighbor. This seems such a petty and needless way to resolve a difference of opinion. No HOA should have authority to pursue litigation against an association member without approval from a majority of the members. The only one who really "wins" in litigation is the attorneys.

Please drop this lawsuit. It seems to me that someone is abusing their authority in this matter.

I have been a resident of Wellington Woods for over ten years. I don't know the details regarding why HOA decided to pursue (and expend funds for) legal action but, on face value, any reasonable person would ask the HOA, "How will this litigation realistically protect and/or benefit those who call Wellington Woods home?"

This is a silly use of our HOA money. The cabana is beautiful...if I had a pool I would ask for the builder's contact ;). Seriously HOA, DROP IT!!!

I have lived in Wellington Woods going on 20 years, we are in our second home. We love the neighborhood so much we built our retirement home here. We have found that the HOA seems to ignore the obvious violations and go after the ones that are in this lawsuit. I have seen the Cabana with my own eyes it was built very professionally and is a great addition to this home pool area. I think in the HOA bylaws it says you can have a pool shed, this is a very nice pool shed. I would ask as a member of this HOA for also 20 years that they not spend my dues money on this lawsuit and drop it immediately. Thanks Kim Clark

It's a beautiful pool cabana. We have no problem with it. We also live right next door. Actually, we are "sandwiched" between TWO beautiful homes with pool cabanas! No problem at all! Why should it be? If I had a pool, I would certainly want a pool cabana!! Why all the FUSS?!

If this tastefully constructed cabana is not within the regulations of our HOA bylaws, then maybe we need to change the bylaws to accommodate what appears to be a very reasonable addition to the property for the enjoyment of the homeowners. I do not want my dues used for such a ridiculous lawsuit. If this litigation leads to a dues assessment next year, I would suggest that portion not be paid.

This is what we spend our time and money on...seriously are we 10 years old? It adds a great amount of value and looks fantastic! I hope this lawsuit is dropped immediately!

My husband and I, as well as our daughter and son-in-law, live in Wellington Woods. We are well aware of the construction of this pool cabana that is tucked away behind the owner's home on a private cul de sac. We're appalled that the HOA is suing these fine people for something that is well built, non-obtrusive and actually adds value to the home. My greater concern is the deterioration of our mailboxes and street signs. Money would be better spent on these repairs and improvements versus legal fees for a frivolous lawsuit.

I completely agree with my wife's comments. This is a ridiculous lawsuit that needs dropped immediately!

Denise and Bruce have done wonderful work on their home since they have moved in. I admire the cabana from our home. It was not done cheaply, and for that I thank them. Being their next door neighbor, I have no problem with their improvements or the cabana whatsoever. I hope that this case is dropped against them, and the HOA can put our dues towards something that actually improves the neighborhood.
