I have no problem with discharges or mortgages and security interests. I am ok with title insurance companies registering mortgages. My only issue is the registration of security interests. In some instances, clients claim to be unaware that the creditor had encumbered their title.

I strongly support it as in my practice I have come across conveyancing people register mortgage and discharged it next day without paying lender for more then 100K.

If you did a title search in advance you would know. Why was a review of title not undertaken? Your client signed an agreement to get a water heater or whatever affixed chattel that specifically make it clear a NOSI will be filed. And now its inconvenient? My guess is Eric Rabkin lost a lucrative NOSI contract to someone faster and cheaper. This petition is political, parading as being concerned about fraud.

I fully support this restriction as the prevalent registration of incorrect instruments creates numerous costly issues for what would otherwise be a standard transaction

As a real estate lawyer I have seen first hand improper registrations by non-lawyers; mortgages discharged on wrong properties/ surviving owner deleted from title instead of deceased owner; etc etc. Another major concern is registration of mortgages without borrowers receiving legal advice. It is about time the Province of Ontario addressed the integrity of the Teraview system by limiting access to lawyers.

Retired lawyer, however I feel the integrity of the system must be retained. Soon lawyers will be squeezed out of Real Estate. Bad idea.

I agree that public interests would be best served through restricted access to registrations. The current system appears flawed and open to fraudulent or mistaken registrations.
