The companies that register Notice of Security Interests on title are awful to deal with. Almost all of the clients I have dealt with were completely unaware there is an encumbrance registered on their title. To make matters worse, most of these companies don't prepare and register their own discharges when the NOSI is paid off which is another charge to the clients that they are not prepared for. They should NOT have the ability to encumber titles without legal advice.

Real Estate clerks spend hours trying to figure out who actually placed a NOSI and who can discharge it. Some clients have many registered on title without their knowledge. I am in favour of this restriction.

The number of clients whose rights have been abused due to Notice of Security documents registered against their title, without their knowledge and consent, is too many to mention. This needs to end.

This is a hole in the system that should be addressed as soon as possible. The discharge of a mortgage is a consequential act that could definitely lead to fraud.

We have absolutely had Notices no one knew about and improperly registered or discharged Charges jeopardize Real Estate transactions. It is incredibly frustrating chasing discharge statements and postponements through companies who seem to feel no sense of urgency or responsibility for the situation. At the end of the day, we are forced to work double time to rectify issues we did not cause.

This is not clear in stating that it is to apply to the the registration of Notice of Security Interests by direct marketing companies. While it is mentioned in the preamble it does not follow through lower on it appears that it is only regarding the DISHARGE of these instruments. I am opposed to non lawyers registering discharges and Notices of Liens.
